Here is the dilemma.... The Idea is great...It can change our lives But if we sit on the idea for long it will rot So DO WE TAKE ACTION or LET US WAIT FOR CORE TO COME UP WITH SOLUTION. I would suggest we form a small committee or group of people who can brainstorm and come up with possible course of actions and then present the idea to core.
This is similar to House->Judiciary committee -> Immigration sub Committee
idea is to analyze the situation and come up with the best solution rather than waiting for
CORE to act on.

On the same note I have a question for the Gurus.
My name is reversed ( first name and last name interchanged) on my SSN and hence on my credit cards, employment letters etc though my name is correct on my passport , H1 , I-797 and on files AOS.. etc.
Will this pose a problem in the name check process?
My attorney said I should change my name with SSN after EAD/AP arrives.
Let me know ur opinions.

Hi currently I am doing my Master's and i will graduate on 2th april 2008. My OPT starts from june 15th 2008 and ends on 14 june 2008.
I am planning to file H1 this year on april 1 2008. I have a letter from chair of graduate studies stating that i will complete all the requirements for masters and graduate at the end of april 2008. Will I qualify for master's quota? If not, if I apply in general quota is that a good Idea or If I skip my H1 this year what should I do.
Instead of Chair of graduate studies can I have letter from any other person in the University coz my chair refused to give me a letter stating that I completed all the requirements for masters.

I thought that with the Sept 2009 bulletin ( PD shifted to 01 Jan 2005 for EB2 India), my PD is current!
Am I missing something?

Eb2 will be better most of the time because many will not be eligible or Job position does not need Masters or 5 years of experience. So it will move fast though it may go back on october. So if possible try to port into EB2 will always be a good idea. CIR or Visa capture bill may not be possible atleast for an year or more. EB1 and EB2 are best bet for next 1 to 2 years.
Dream on about porting from Eb3 to EB2. On an average it is taking more 9 months to get labor clearence that too if it is eb3. if you are trying eb2 that is almost a definite audit. We have a case in our company which was stuck in audit (eb2) for more than an year now. our company and attorney are no longer filing eb2 (offcourse it is a different matter than they are no longer filing any green card application because of layoffs). So unless you are working for a desi "con"sultant company not many american companies (almosy none) are filing eb3 green card perm applications leave alone eb3 to eb2 conversions. Even desi companies are scared shit because USCIS is knocking the living daylights out of them. Even desi companies are scared of filing eb3 green card perm applications leave alone eb2. So good luck with your eb3 to eb2 dream.

There are a growing number of reports from the H-1B cap filers beginning from late yesterday that they started receiving "refund" of filing fees from the CSC or VSC. These are the cases of the petitioners whose filing fee checks have been cashed by the Service Centers. We do not know whether this news implies that the USCIS has completed the job of sorting-out and data-enties for all the cases and the random selection process has commenced. Assuming otherwise, one wonders how they have decided that these cases have been not selected and the filing fees should be refunded. There are two theories as to how the random selection would be conducted. Obviously, the entire cases should be data-entried before they can start a random selection process. Otherwise, the random selection process will be not scientic and too arbitrary. But no one knows. Other theory is that the checks will not be deposited until the selections are made. Currently the process of random selection remains a mystery. Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.
Thanks for any replies.

I hope your final version will correct the addressing to the members of congress.
Please avoid using "Dear Zoe Lofgren" kind of addressing. More appropriate would be "Honorable congressman/woman XXXXXX"

According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India

However, in the event that USCIS received more than 20,000 cases that would qualify for this exemption on April 2 and April 3, USCIS will first conduct a computer-generated radom lottery to select 20,000 filings for processing, and those filings that are not selected will be subject to the FY 2008 cap and must be considered in that random selection process as well.
