Yes he can apply for a TN again, no limit on the number of times alien can enter on TN. If he leaves while his COS is pending it will be considered to be abandonment of the petition.

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

I think it should be OK!
-> i guess there is a provision to delay your FP if it arrives for any reason, any of your representative here can scan and let u see the contents , there will be a phone to call and postpone.
-> if you are C9 category ( 485 in EB category ) , you donot need i94 number , you need alien number.

As long as they have valid visa, there should not be any problem entering after short gap outside USA.
I guess IO can object if this happens very frequently but in that case they will warn first rather than taking other action.

Hello,
If someone is going to be filing for I-140 on a recently approved EB2 (India) while on H1-B in USA with same employer, is it better to check the first box (Alien will apply for visa at a consulate abroad - meaning consular processing of 485) instead of AOS? My understanding is once I-140 is approved and if 485 dates become current, then if CP has been indicated on I-140, then the consulate abroad will order visa number in the month after and the person should get an interview call, even if the dates retrogress back in the following months?
In that case indicating CP is better than AOS on I-140? If so, can the person continue to work on H-1 while waiting for the interview call at consulate abroad?
Thoughts appreciated. Anyone please?

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

Thanks for the suggestions. I called in the National Service Center and put in a request to expedite the case. Got an email that I can try to visit the local ASC and see if they can collect the biometric. We visited the local ASC today and the were kind enough to collect the Biometric. I hope we get the AP before the departure date..
