Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!

Most likely, a clerical mistake of some kind was made. Your wife should call the National Customer Service Center to start the inquiry process.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India
Can she travel on H4 stamping or she need to get AP

Hi All
Need some help here to understand what i should expect. Here is my case
Currently on EAD with my spouse as the primary applicant. I plan to travel outside US and return may be after a yr.
Assuming that i have satisfied the 180 days for this yr
1) what will happen if I dont spend the required time in the US next yr ?
2) Can i apply for AP from outside US next yr
3) Will i loose my EAD?
4) What is the process to re-apply if i will loose it?

Thank you frostrated and madmonkey for your responses. We had taken infopass and were able to speak to immigration officer too. That is where we were told there is nothing like linking or interfiling. I read the pearson memo multiple times but it says both dates must be current. EB2 is not current and hence do not know the validity of the claim. I will try infopass again and see before filing MTR.

You don't have to leave the country if your change of status to H1 is approved with a new I-94 attached to it. However, if they approve COS without providing new I-94 then you need to immediately leave the country and re-enter with a new visa stamp.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

Hi,
I went to infopass inquiry today. Immigration agent told me on counter that my I485 is in final review stage and you don�t have to worry about I140. You can receive your GC very soon.
I filed I485 based on pending I140 with PD Jun 2004 and this is still pending. My other I180 that is approved has PD March 2008. Agent also told me that I should forget about I140 and PD. I485 cannot in Final stage if I140 is not clear. He told you should not worry about PD also because I485 cannot be in final review stage if there is PD issue.
My I485 is in EB2 category and currently USCIS is processing the cases with PD 2005 or less.
Can some please explain me that what does the Final Review stage means? Is that mean I will get GC pretty soon even my I140 and PD combination is not approved/ current.

I am planning to visit Canada sometime in the summer, and being Indian, I need a visitor's visa.
The Canadian consulate doesn't have much information about Advance Parole holders in the US applying for a visitor's visa, and it looks like the process is the same as for F-1, H-1B holders.
I am wondering if I need to send the original AP (as a supporting document) or if a copy will do.
I can't go to the consulate in person, and have to send my stuff in the mail, or this wouldn't have been an issue.

I have my I-140 approved from Company A(Future Emp) PD 2002 and 485 PENDING . Since Visa category is current.
My current company B is asking me to apply for I-485 PD 2005 and withdraw 485 from Company A. Since PD of
Company A is 2002. I dont want to loose the opportunity. Should I join Company A/ Stick with Compamy B.
