nope, if the alternative to the GC system is outsourcing (as you yourself mentioned) all the profits go to big corporations and our salaries are spent in India. The corporations are notorious for avoiding taxes so teh government gets nothing. By making us stay here longer (on H1 or GC) we end up spending our salaries here, paying taxes, paying social security, paying medicare.
65K H1-Bs earning 70k a year is 4.5 billion dollars. 140K new GC holders each year earning the same comes out to 10 billion dollars. Out of that taxes alone are an easy couple of billion or more dollars. Then take into account the side-effect (we buy cars, we buy appliances, we rent apartments) and the contributions we make to this economy are a lot.
And to say that we are stealing jobs is also inaccurate. There is nothing called stealing-a-job. In general every job is worth how much someone is willing to be paid to do it. If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K. The H1-B visa holder is not stealing a job. The days of knowing HTML tags and commanding a salary of 100K a year (1999-2000) are long gone and now replaced by 'that kind of work gets done in India or Ukraine for 10k a year'. Looking at the resumes we got in response to job ads placed in the last 3 companies I worked for, there are simply not enough qualified americans interested. Thats a fact. So the IT sector needs help from abroad to get the job done. They can either send the work over, or bring the people here. Bringing the people here also benefits the rest of the economy.

I am not able to start and feel that there is already hidden membership is there. Is there any thuth in this feeling? How does IV is working in terms of access rights?
IV is already not member friendly. With 25,000 members, raising 30,000 is getting so difficult. Why so? I once posed the question and moderators conveniently deleted it.

if "members" are willing to make this their organization their own- if there is to be this sense of involvement and ownership, then we will succeed. if not, if the attitude for the most is going to be "why should i" and "nope i am not contributing" and "how dare you ask" and "i have free speech" and "why doesn't iv do xyz for me" and "why should logiclife use this and that tenor" and "why did abc say def to me" and "i demand respect" and the best "these are my 2c but don't ask me to lift a finger to do this- iv should do this" then forget it. won't happen. because that IV you are imagining doing wonders and making miracles is YOU.

Come-on members who have not contributed at all. Small donation of $25 or $50 will not hurt your pocket. Only if 2000 members contribute $25/- , it will sum upto 50K.

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.
and also we can transfer our H1 to new company also. thats what i am doing now.

Duration for I-94 while entering on AP is same as validity for AP. I am not sure what will happen in the scenario below:
A person on H1B validity for two years enters US on AP, which was valid for an year. He/She gets I-94 for only one year. in case person do not have any travel plan for next two year, will he be out of status after year as I-94 would have expird after one year and he/she kept working for H1B sponserer for two years.
Another questuon is Does renewed AP also comes with new I-94, like H1B renewals?

BEST OF LUCK FOR THOSE WHO ARE WAITING...Believe me "appka bhi number aayega" I was loosing hopes - since Sept 1 when saw number of approvals after my PD/RD/ND etc..but there is really nothing that can predict this system.

I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.
Anyway, I doubt if it's anything that can't be fixed; my company is very reputable and our attorneys are already engaged.
You had mentioned in your previous post that your EB2 green card was approved in June 2007or did you mean EAD?

Since I joined IV this thing defintely changed...& I feel that I am attached to a community trying to achieve a common goal and common good. IV has done a splendid job in getting the community united at the grassroots ....even some of initiators of the group have got their GCs, I still see them involved, which is a great thing. Why blame IV for the legislation failures? Blame congress for it & even 75% of Americans feel Congress is not doing their job.

My H1 which was approved back in 2006 has been re-opened today...This is the status I see on USCIS web-site
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on April 26, 2009, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. I have used AC-21 and been working with new employer on EAD since April, 2008. I talked to my old employer and they said they have sent a request to withdraw my H-1B and all other immigration applications. So, I am assuming that they have also withdrawn 140. He also said when someone leaves the company its a normal process to withdraw all the immigration related documents.
Can you please tell me, what will happen to my cases. If someone has gone through the same, if they can share their experiece that will be really appreciated.
My H1 which was approved back in 2006 has been re-opened today...This is the status I see on USCIS web-site

You can trade commodities like stocks by taking a directional bet on long term price movement. But this is what you need to consider. Stocks always trade in Spot. If you buy MSFT you own shares of Microsoft today. Although single stock futures (SSF) are available now we will not look at derivatives right now.
Commodities are traded as futures. You can buy Soy futures today for December delivery or lean hogs for dec 2010 delivery.
Under conditions of No-Arbitrage the price of the future will be the price of the spot plus storage and delivery costs. If for example 3 month LSC (Light Sweet crude) is trading on NYMEX at $60; the cost of storage and delivery is say $20 for 3 months. Then 6 month LSC should be trading at $80. But if you look at the contract it might be trading at $55.
The reason being fundamentals. The peak driving season or the hurricane season is over and heating oil season is not yet on us or by looking at weather derivatives traders are factoring in milder winter. The leader of Iran has declared he will step down from office and retire to Hawaii, the rebels in Nigeria have turned themselves in and joined a church missionary..stuff like that.
So you might believe these fundamental assumptions or you might do your own research and say that the traders are wrong and they are discounting critical factors and the price should be more. So you can go long the future and hope for an increase in price and sell the future before delivery for a profit. This is the expensive route but you will never be wiped out for sure. Price of crude may drop but will never go to zero.
Or you trade options on the futures, for example:
Borrow money (leverage) buy the call; short delta units of the future contract and invest the proceeds at the risk free rate.
If you are correct the call will end up in the money, the shorted futures will loose value but since it is “delta” units it is only a portion of the position and the invested money will earn you the risk free rate. So you make some money on the call and loose some on the hedge and net you will profit. (Hopefully to cover the transaction costs and taxes)
If you are wrong (price falls) your call will expire worth less so you are wiped out there, your short will increase in value and you will still earn the risk free rate. So although net you will loose money it will not be as much as a naked call because of delta hedging.
This is explained in very very simple terms. Each transaction step will indicate modeling prices to know if the future is priced correctly, if the option is priced correctly and if the leverage you are getting is correct. Plus modeling future price movements and expected rate of returns and the most primary thing in any transaction the “Alpha”. Source of alpha should be very clearly defined. Let me go a bit deep and include some simple math:

Where E[R] is the expected return-(see statists for more on expectation functions.)

Jumps are spikes of very short duration which will only be seen in a log normal price distribution. A Gaussian distribution might not be changed much because of a spike of small duration. For example if you are trading electricity and the temperature in NJ hits 110 degrees, there is going to be a spike on that day for electricity prices but this will fall as soon as temperature falls.
And the core issue of all is you need to have access to products as indicated by puddonhead plus money and leverage capacity and risk bearing capacity. As you see this is not for the faint of heart or for some one to do part time. If you are really sophisticated and can do this with good resources, fine or else my advice is stick to stocks or stock derivatives. Hedge funds have teams of quants and super computers sitting and doing this every day. They will vacuum out even the slightest of alpha out there; they will simply take your money if you enter into a wrong trade. If someone is a quant and does this for a living then if his contract allows it or if his licensing allows it legally he can do it on the side but apart from it definitely not something the retail investor should indulge in. Just invest in some ETF like GLD or USO or some commodity mutual funds at the max.

So do you think they are going after AC21 folks as a scapegoat? I spoke to few people on this including lawyers and they say that "denials on 485" when 140 gets revoked is a common thing and usually the officer who issues the denial letter does not check and verify to see other details. Thats why they have to go through the MTR process.
Although, UN seems to suspect that there might be more beneath the surface here.
What still beats me is that if the 140 had problems, why would they even bother requesting for AC21 evidence and not just deny the 485 in the first place.
Unless..., when the 140 got revoked they realized that it had been more than a 180 days since the 485 was filed, and gave the applicant the benefit of doubt and asked for a new EVL, but while the applicant was in the process of replying to the NOID, they did some more digging, found that the underlying approved 140 had ability to pay (or other) issues and then denied the 485 on that basis.

I have worked for some of the big Indian IT companies including HCL Technologies and Satyam and can tell you all that these companies are the most screwed up companies in terms of bringing in H1 and L1s from India and paying them peanuts for salaries. For example Satyam and TCS here in St Louis have a large outsourcing deal with Citigroup. There are about 50-60 Satyam Engineers here on H1 and L1 visas being paid around $45,000 per month+Benefits which is just about the Labor prevailing wage in this area.
Talk about rotten Desi companies and even the bigger players are not far behind in trying to suppress wages for Engineers and bending rules in lots of instances to bring in a flood of L1s/H1s from India to work on onsite projects.

Yes many employer will open a new company but given a choice to follow the law or open a new company and start from scratch; I am sure most will follow the law. Also how many new companies will they open. If everybody files a complaint every time someone is exploited the employer will have to either stop exploiting or stop doing business.
Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

(1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I believe , nitin has the right to voice his opinion (many people would agree with him, many would disagree). But there is no need to fight like illiterate people. If someone doesn't agree , he should say i don't agree, and this is what i believe in.
I like US very much , i am here for around 5 years , and i believe the GC system really sucks (don't you ?)But i have some commitments in India , and if i don't get a GC in 1-2 years i will go back. All my college batch mates in India are managers now , and i am still a developer. I cant take a better job , because i don't have a GC, and with EB3 India, by the time i will get a GC, i would be about to retire :-)
