Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.

A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.

I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.

People who crib about not getting a chance, even though their job description did not support it are wrong, IMO. NO ONE forced you in to that job. This is not slavery and US is not the only place where you can get a job.

Thank you for adding some rationality to the discussion.

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

Anyone thinking that there will be a bill passed in near future that will overhaul skilled immigration process needs a reality check. Now I am not discouraging anyone from trying, I am also suffering through this mess and in no better position. The reasoning behind my assumption is following:

    1. Lawmakers serve America and Americans. In theory anything that passes must look like it is serving their interest. Most laws/actions MUST look like it is helping Americans directly or indirectly, more so in an election year. That's why with less than 60 days for election it is not wise for them to spend time in enacting and debating laws that helps immigrants. It simply makes no sense.

    2. You can argue that helping skilled immigrants will help America greatly and there is an urgency to enact such laws. Unfortunately no matter what media says, there is no such urgency seen by either law makers or their advisers. The reason, being there is no mass exodus for skilled immigrants, I know a few who have gone back but most of us are still here waiting for visa bulletin evey month hoping that some miracle will happen some day. Even if there is a mass exodus, there are enough people in India/China/Eastern Europe who will be more than happy to be here and do whatever we are doing. Simple law of numbers.

    3. It can also be argued that America is not producing enough talents in Science and technology and hence we should throw a red carpet to anyone who can buy his way through the MS program from an American university. Unfortunately for us, a lot of us are doing mundane jobs and do not make a big impact in the economy the way techies used to be in late 90's. The best and the brightest are well taken care of (read: EB1/NIW) even today, for the rest us there isn't a desire nor a need to expidite the process in any manner. It will only help us, and we don't matter.

    4. There isn't much shortage of skilled professionals, definitely not of the proportion that 65,000 visas are gone in 2 months. The only shortage I see is of numbers of "Visas". Although it is hard to find good people in technology but that problem cannot be solved by making that number higher. I am not sure what's the reason.

So what can we do ?
In short we are just a John Doe seeking better life which unfortunately isn't there in our home country. We should enhance our Skills (NOT skill bill) and help ourself to do well in anywhere. One thing is use 3 years extensions to chnage jobs and do well.

We can also align ourselves with H1B lobby/Healthcare lobby and request to file I-485 without visa numbers. That will at least stop some of the indentured servitude and our spouses can work.

    smisachu,
Thanks for that Info, here is my requirement
I am on H1B and plan to have my own company as a trader to trade stocks.
I will be the owner and wish to draw profits, may not have employee in my company for now(please advice, if i need to)
I need inputs to know what type of company should that be (LLC, S Corporation.. e.t.c.)?
Is it advisable to have a GC holder/citizen as partner?
What form of income should i withdraw(salary/profits/dividends/Interest..) How is the income considered when i file my taxes?
I am not aware of anyone who can sponsor my H1 as a trader atleast for now, if i get the right opportunity, i am open for that
    Thanks again

    1. If you want to trade stocks only, with your own capital ,then set up a LLC or C corp. If you trade other peoples capital then maybe become a RIA.
    2. If you form a llc you become a employee of your own company (say managing director, CIO etc) and sponsor your own H1.
    3. You can have a fixed salary and a draw, which is what a typical trader gets. Draw is a percentage of the profits you generate by trading.
    4. You dont need a gc/Citizen as a partner.
    5. The company/fund makes money by trading securities and the earnings are retained by the company, you draw salary and bonus.
    6. You file taxes as a regular employee would.
    7. You might be able to get H1 from a day trading firm, a day trading firm is not a market maker. They trade company capital and typically you have to post some risk capital based on which they will provide you leverage and provide you with equipment etc. You dont get a salary, just a draw.

But let me ask you something; I am not aware of your expertise in the markets so forgive me if I sound patronizing.
    1. Do you have a seven figure capital pool? You will need at least 1MM if you want to make a living trading.
    2. Are you aware of the equipment and ECN and direct access software needed assuming you are technical trader.
    3. Do you have a prime broker who is going to provide you leverage and settlement? If you have not decided consider Interactive Brokers.
    4. What kind of risk management software will you be using?

If you are in the NY/Nj area I suggest try day trading at a firm posting risk capital (typically 10K) then decide if you want to do this full time. It will also help sharpen your skills. If you want I can recommend a few. They will not sponsor H1 though, you will have to have some consultant do that for you.

I guess it has less to do with estimates, and more about looking at the landscape. If there are significant portion of responses are above your date, one might, for example, choose to initiate porting/reclassification process if one qualifies for it.

Good thread. I am wondering the reasons for lack of response between Jan and March of 2002.

I am wondering the same for 2002 applicants. I wonder if many people were approved in 2007 fiasco and if yes, then why PD is stuck at Nov 2001?

Yes, I have the same question. Everything is a good practice recommendation. That is confusing.
And I thought it was one year. Is it 6 months?

    Hi,

I heard it is six months. But someone should clarify whether its 6 or 1 yr. And also it is really necessary to work for 6 months/1 Yr or not??

    Right TRACK Act

KENNEDY PUTS FORTH PLAN TO JUMPSTART AMERICAN COMPETITIVENESS
Gives Major Address On Turning Era of Globalization into a New Era of Opportunity for America

Boston, MAToday, Senator Edward M. Kennedy was at Northeastern University to deliver a major address on his plan to reinvest in America's competitiveness and turn around damaging impact of the global economy. He was joined by President Richard Freeland, business leaders, students and educators to share his ideas of how to this country back on track.

Kennedy argues that our nation is at a crossroads: we can continue to be buffeted by the harsh winds of the global economy or we can think anew, and guide the currents of globalization with a new progressive vision that strengthens America and equips our citizens to move competitively to the future. He believes that we cannot advance forward by continuing down the same path of the last five years that put special interests over America's interests by cutting back on investments in education, invention, and innovation, as the Administration has done.

He said, "The 20th century was widely hailed as the American century is up for grabs. No nation is guaranteed a future of lasting prosperity. We have to work for it. We have to sacrifice for it. We must open new doors and new avenues for all Americans to make the most of their God-given talents and rekindle the fires of innovation in society. By doing so, we can turn this era of globalization into a new era of opportunity for America."

Senator Kennedy proposed a plan to move the country forward and to restore America's advantage in the workforce, education, health care and research and development. As he outlined it he said, "The essence of the American Dream is the ability to provide a better life for yourself and your family. At its very heart are a good job, first-class education, good health care, and a secure retirement. Some say the dream is out of reach in today's global economy. But I'm here today to tell you it doesn't have to be that way. We can revitalize the American Dream. "

Senator Kennedy's bill, the Right TRACK Act (The Right Time to Reinvest in America's Competitiveness) seeks to:

    1) Create high quality jobs

    2) Educate Americans to fill the jobs of the future

    3) Preserve good jobs in the US

    4) Level the Playing field for US workers and businesses abroad

    5) Help those harmed by globalization, workers and communities

    6) Modernize U.S. Labor and Employment Laws
