    How does one get to know if his Labor Substitution was rejected? If a Receipt Notice was received does that mean that it was accepted? And, can they reject it later?

    Receipt Notice means they accepted the case for reveiwing. I guess these rejections came after they reveiwed the case.

    Looks like you know a lot about non profit companies that sponsor cap exempt h1bs, can you please provide a list or a few jobs that are posted under this category...or atleast where to start looking for these jobs...?

    These kind of cap exempt visas are only sponsered by Universities and very few research organizations....there arent many comapnies out there for non profit reasons..please dont throw suggestions/advices just for the heck of it...

    you will be surprised to see how many not for profits are out there... so dont throw there "arnt many companies" words of encouragement

    and with someone that has a phd i don't think it should be difficult

    i did not throw suggestion for the heck of it... go through all the msgs to see if anyone suggested anything besides saying sorry to hear about your situation

    Hi,
    Here is my situation:

    Company A:
    EB2 PD Aug 2006
    140 Approved
    485 Applied July '07 (Got EAD and AP for myself and wife. I am still on H1B but wife used EAD)
    Still working with Company A and intend to work with them for another couple of years.

    Company B:
    EB2 PD Nov 2005 (Substitution labor)
    140 Approved.



    Can I interfile or do the PD porting so that I can get the older PD? If so, do I have to work for Company B?
    I dont have a copy of the LCA and I may not have the original of the approved 140. Can I use a copy of 140 approval notice to apply for the interfile?
    Do I need any kind of document from Company B like employment letter in future ?
    Does the PD need to be current to interfile?
    Do I need to work for Company B?
    Does this process in anyway create problems for my current 485 status? My wife used EAD but I have been on H1B with the company that filed for my 485.
    I already completed 180 days after filing 485. So, I can use AC21. Will this interfiling process have any impact on that?
    How would I know that interfiling process completed successfully?
    If USCIS denys the interfile I submitted, does that have any impact on my current 485 process?
    If I want to use AC21, does that new job need be similar to Company A or Company B job requirement?

    My case is similar to yours except for me the company was the same for both I140s. The only thing my lawyer sent with the request was the Original I140 Approval Notice on the Second (Older PD) I140 (In your case that is Company A's I140). When the AOS application was filed, the Original I140 of Company A was used. The basic content of the letter is already explained in previous posts on this thread. Read them carefully. Also, consult a prudent and capabale lawyer who has some experience in successful Interfiling cases.

    If both the I140s are approved on your name, there should be no issue as they have already done all the work related to Proferred Wage, DOL work categories (SOC codes), etc. AOS is just for adjustment into PR status on the basis of approved I140, of which you have two.

    I am no lawyer, therefore, please consult a good lawyer to make sure all your questions are answered.

    everyone has to go thru namecheck process. Once during greencard process and once again during citizenship process. (if and when you apply for citizenship.)

    To find out about namecheck, you can call USCIS and if you get an officer on the line (not the cust service representative ), then you can find out.

    You can also find out about the status of your namecheck with infopass appointment. That will take up some of your time.

    FYI: USCIS does not charge for Visa Lottery... It's FREE.

    Yes sir, they do.

    If you are chosen and pass the first screening, when they ask for documents you are also sending application fee that is around 500$. And GC is still not guranteed if the chosen applicant cannot persuade IO he will settle successfully. You need to show the ties, someone to help you with the job, show the moneys for the first few months, etc etc..

    I personally know several people who were refused based on their family size and that they would be below poverty line if they immigrate into US.

    Go figure!
    GC lottery is the biggest joke ...

    BTW, application fees are nonrefundable..

    As we all know, the Housing crisis in US is getting worse day by day, with the inventory of houses available for sale increasing, and buyers not willing/able to buy those houses.

    Giving speedy Green Cards to July Visa bulletin cases will ease the Housing Crisis in US.

    Most of the people affected by the July Visa bulletin are highly skilled people who have the capacity to buy houses, but are not investing in houses, since their future in US is not secure until they get Green Cards.

    Instead they end up investing in real estate in Bangalore/Hyderabad etc, thereby helping in housing boom in those places.

    If Congress passes a law to give speedy Green Cards to these highly skilled people ASAP; these highly skilled people, who have good jobs and capacity to buy houses inspite of the difficult situation regarding getting loans etc, will help US tide over the current difficult housing situation.

    This is something for the US law makers to ponder.

    EB-4: N/A
    EB-5: C

    Can any one tell me what EB-3EW means?

    EB2, India, PD-oct 2003, RD-June 2007, I485- May 1st 2008.

    o Nothing materially and noticeably. A minor nuisance out of the way.
    - What did you do on the day you received it?
    o Was glad but no celebration.
    - How did the long wait upset your life?
    o Yes for a while. But the entire episode changed my outlook and showed me a different perspective. After being frustrated for a while I realized I should not called myself �skilled� if I cannot navigate the rather simple green card mess. People are successful despite extraordinary physical handicaps and here I was restraining myself under the simple excuse of GC. I realized that I had to and could create oppurtunities for myself, without GC and without being in the US. Fortunately at that very time I got my EAD (June 2007). I gave myself a hard limit of 1 year and if GC did not materialize in a year I would ditch the effort and move to plan B. By april this year I began taking steps towards a change of job. My prospective job title was going were different but I was willing to risk the GC. Now I was wishing I should not get a GC since I would need to shelve plan B for 6 months. And suddenly on May 1st I got the GC, just when I did not want it!
    - How did immigrationvoice help you during this long wait?
    o Tremendously. When GC was important to me, it gave me a platform where I could act to make a change. I haven�t been active but just contributed a couple of hundred dollars to the cause.
    - Would you like to continue your support to immigration voice and help others waiting?
    o No, the cause has long ceased to be important to me.
    - Any advice for everyone?
    o Don�t create impediments for yourself by hanging onto GC and getting frustrated. Move on, there is plenty of good life outside clutches of GC!

    Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
    EB3ROW may move also.
    The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

    In Dallas (Las Collinas), if you dont have medical insurance, you can have an arrangement with the Doctor and Hospital.

    Like one of my friend paid 3K for everything for Delivery + 5K I think for the hospitals. Ofcourse this is based on the delivery is not complicated / C-section couple of years ago.

    Note that the TSC processing date for EB I-485 moved back to April from May 24, 2007. So the flood of applicants from June are certainly not "within normal processing times" even if they fell out of the BECs and have an early PD, and have a namecheck pending >180 days.

    I agree that sucks. They should be processing based on PD and not RD. But when and if this >180 days policy for namecheck gets streamlined, and with PERM implemented, processing will be more FIFO than ever, even though IOs work on their own whims and timelines. I doubt visagate filers will see FIFO, but future filers will.

    I support this action item.

    Here is my story. I came to US in 2001 and was able to get the visa stamping done in US twice. My visa expired in 2005. Since the revalidation in US is stopped in 2004, i did not go to India until i received my AP in 2007. This is because i know couple of friends (brothers) who were stuck in India for almost 3 months when they went for marriage in 2005. So i decided not to take the risk. I went to India in 2008 and returned back on AP.

    Now i cannot use AP anymore because my I140 was denied by USCIS. This is for sure an error by USCIS. In the denial letter they said my company applied for X number of green cards which is not true. Green cards applied by the company are too low compared to the number provided by the USCIS. My appeal is pending at AAO. If the revalidation of visa can be done in US, i can get it stamped and visit the family in India instead of waiting for the decision on the appeal.
