I would like to know How to file a complaint about labor fraud? I just found out that my employer didn't file 485 for me and instead he used the labor for someone else. Is there anyway I can file a complaint? I have no other option except to wait until the dates are current again. I paid all the expenses for labor, 140 and 485.
I don't think I can truly understand how frustrated and angry you must be and I really hope there is a legal avenue by which you could atleast get some kind of monetary reward. I hope you could take this employer through the DOL fraud dept and cause him to really pay for this.
One of the side benefits of the end of labor substitutions is that unscrupulous employers like your desi employer will not be able to sell a labor to the highest bidder or give it away to a new hire as a 'sign on' bonus. Either the original candidate gets it or goes to waste. Though it seems a little tough, it more than makes up by preventing such stories as yours in the future. Good luck

Hi All FP seekers! I do not know what exactly I am missing if there is a delay in FP. It looks like hundreds of IV members are too much worried because of the 'delay' in FP. Let me worry too (by knowing the big problem!). Can any worriers explain??
On the other hand is it not better to have a late FP, so that you need not go again in the next 15 months! Anyway for most people GC is going to take years!
It's the uncertainty of the entire process that kills us...Have seen couple of users whose cases have been erroneoulsy denied since they did not went for their biometrics. Guess what, these users never received any FP notice from USCIS. I tend to partially agree with you; if the PD is no where close to being current, why worry about FP now - it's their responsibility to get us finger printed. But on the other hand, I do not want my case to be erroneously denied because of an error in their processing...

There is a question about removing per country limit at the end.These morons are very concerned that no single country (meaning China and India) overwhelm the supply of immigrant visa's. I wonder if they will consider applying country limits when passing amnesty :D

"If the votes were there, you wouldn't need to have the meeting. You could go to a roll call," Emanuel told reporters during an hour-long breakfast.
About 20 senators and House members are due to arrive at the White House at 2 p.m. for the discussion in the State Dining Room. Aides to the president said the meeting was intended to "launch a policy conversation by having an honest discussion about the issues and identifying areas of agreement and areas where we still have work to do."
The president will announce administrative actions that the White House has already taken to chip away at the issues, including a modernization of computers that allow people to quickly see their immigration status. Officials said the White House hopes to begin the more controversial debate over a comprehensive approach to address illegal immigration later this year.
But Emanuel offered reporters a more realistic assessment, saying that while it is "not impossible" to get immigration reform done this year, it is more likely to be pushed off.
"It's not impossible to do it this year," he said. "Could you get it in this year? Yes. I think the more important thing is to get it started this year."
Responding to a question about the political implications for Democrats of delay, Emanuel said, "It's better that it happens politically. It's also better that we continue to focus on improving the economy."

My Job duties on labor says
"Design, develop and test software using Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP"
The title in labor is "Software Engineer"
Now the new job offer has title as "Lead Developer"
and duties are
"The lead developer will be responsible for leading a team to creating components within Java, utilizing standard Integrated Development Environments (IDEs), writing unit test cases and supporting the Testing and Quality Assurance phases of the software development lifecycle."
Can somebody comment on this in context of same / similar job?
Wow, any company would love to hire someone that is capable of Designing, developing and testing software in Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP...That's very very versatile....I work on SAP, just SAP, and I already feel like its a ocean. Maybe that's why I'm in EB3.

2+ 3 you are mentioning is where +3 = three year degree program like BSc / BCS/ BCom programs offered in India. Here I think we are discussing 3 year DIPLOMA program the eligiblity for which is 10th grade. After finishing this program in some universities you are waived 1st year coursework for the degree program in same field. So for regular people it is 10+2+4 to get a bachelors where as people taking the diploma route it is 10+3+3. So in this case of our friend his 10+3 is equivalent to completed only 1st year degree program. the +2 overlaps with what he has studied in +3 and the +1 in commerce will not be counted in coursework.
Anuj: What subject was your diploma was it a management diploma or engineering diploma? What was the eligiblity for the same? Was the institute reputed like does it have an entrance test? If yes do you know their acceptance rate? Might help in preparing a case

I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.

Do this: Be happy with what you already have and expect (don�t worry) more good things in life. Just compare with somebody who doesn't even have food, clothes, shelter, health care, etc... in their lives.
You are VERY fortunate to make it to US and living a decent life than most of the Indians.

Yup, i went back to my homecountry in February after 10 years away from home and trust me, our lives here are good. People back there will trade your place in a heartbeat. Just be glad that you are in the pipeline for a PR.

The truest gem is this other line: "In the unlikely event that DHS receives actionable information after the application is approved, it will initiate removal proceedings."
So all they were waiting for these unlikely events to happen while they kept hundreds of thousands of applicants in the deep freeze at USCIS?!
