    Seems like everyone losing hope including core - as someone else said above its really sad to see this. Please dont lose hope at this critical moment else all of our efforts for last two years will go waste.

    I cant imagine how much time/effort has been put into this effort by core members (as a relatively inactive member I myself could have easily spent several hundred hours on these forums in last year and half; and atleast some time in calling/faxing etc.). After all these efforts and seeing the current bill its understandable to get deeply disappointed. But dont lose hope yet. Its not over.

    Logiclife - coming this from you really shook me. At one point you were so confident that having our measures in any future CIR is but gauranteed - we thought its just a matter of time. All of us were also thinking that we are in a better position to introduce and enact amendments in this congress. We still have time (2 weeks) for amendments - why are we thinking about alternate arrangements and slowly losing hope. Does this show our level of confidence now or this thread is meant for some light hearted fun?

    I am trying to mock the bill. Cant we take a joke?

    I have been to DC 4 times this year in 2007 and I or other core group members are not going to give up on amendments. And Aman has been there every 2 weeks. I am not kidding. He has been there either on Mon-Tue or Thu-Fri 2 times each month doing meetings in Senate offices and educating and finding sponsors. We are not going to give up now after all that hard work just because the bill is ridiculous.

    Just because I am taunting the injustice of the bill doesnt mean that I or others have given up. WE ARE in position to put in amendments. How much, I dont know. But pretty sure that we will make a good amount of difference.

    But dont let your hopes down because of a sarcastic comment on the bill. Take it as a joke or ignore it.

    I am not with them anymore, I transfered my H1 to another company already. i just need to find out the way how to file a complaint and proceed further.

    That's good to know that you transferred your H1-B.

    As people already suggested there are very slim chances you can do anything about this, since labor and I-140 belongs the the employer. So if you can prove with written statements from your employer that he will sponsor your GC and if can prove that have incurred monetary loss, you might be able to get something out of this.

    On a side note, You may want to see if there is any other options to bring him down, such as if you were on H1-B and if your employer did not pay you the salary he promised. This definitely will put him on the black list and he cannot hire anybody else on H1-B. All the best!

    i work in a big software corp and never heard of any queries at all?
    approved 140, file 485, wait for 180 days, change jobs, no queries at all (irrespective of whether you change jobs or not)

    am i missing something here?

    For all those people who haven't been willing to donate to IV until now, let this Immigraton Fee Rise serve as a wake up call.

    Do you want to pay $60 to IV now, or pay 10X that amount in June (when filing fee will rise by almost $600 for 485 filing)??

    I know some people didn't want to contribute to IV, but now the choice is clear: pay $60 to IV now for its efforts or pay $600 to USCIS in June (where there will be no choice left but to pay up).

    "Obviously the GOP had a big night tonight, maybe historical," said Craig Shirley, a Ronald Reagan biographer and longtime GOP adviser. History is made by what you do and not by what you won't do.

    This election is nonetheless significant for several reasons. First, the House of Representative has now switched hands between the two major parties three times in the last nine elections. This suggests that volatility in the House of Representatives is now a constant in political life. It is unlikely that in the near future either party will dominate the House the way the Democrats did for much of the last seven decades of the 20th Century. The Republicans may hold on to the House longer than the Democrats just have, but it will likely be only for a handful of terms, not a handful of decades as the Democrats did between 1955-1994.

    Second, and more importantly, with control of the government now divided between the two parties, it will no longer be easy for the Republicans to blame the Democrats for the state of the economy. Nor will it be possible for the Republicans to simply say no to everything that is proposed in Washington. That strategy was useful when the Republicans were completely out of power, but the context has now changed.

    This may lead to better bipartisan cooperation in Washington, but that is unlikely, particularly given the a real possibility that economic recovery will not happen by 2012, not because of the failure of politicians in Washington to address the problem, but because of the depth and seriousness of the problem itself. Given the difficulty of fixing the economy, even if both parties were willing to cooperate towards that end, the more potent strategy would be for both parties to increase the partisan rancor in Washington by blaming each other, accusing the other side of destroying the country and the like.

    Dug the hole for 8 years, expect prosperity in 18 months!!!!

    This is crazy if this is how USCIS or DHS or whoever is going to interpret the law. We need some clarification from an experienced attorney. From the visa bulletin in Nov 2005, it does seem that USCIS is saying over subscribed countries will only get 7% in FY2006 and AC21 will not apply. If its only 2800 for EB2 and EB3 India then priority dates will never reach somewhere like 2005 or 06 for Indian nationals.

    May be this explains why priority dates have got stuck at Jan 03 for EB2 India since october 2006.

    I tend to agree too that nothing will happen, too much talking, too much BS, but, I can only hope that the republicans know that they can loose the house control, so, maybe they will prefer to have something more conservative than nothing.

    If this is true, this seems to be good news for us. The McCain Kennedy bill is the most pro-immigrant of the bills and if thats what becomes the Comprehensive Immigration Bill, we all might end up happy!

    WASHINGTON � The Senate Judiciary Committee today reached agreement on proposals for a new guest-worker program and a plan to allow the estimated 12 million illegal immigrants living in the United States to become permanent residents.

    Less than 24 hours after most experts and Capitol Hill watchers believed the committee would be unable to get a bill to the Senate floor by Majority Leader Bill Frist's March 27 deadline, committee Chairman Arlen Specter had brokered deals between some key senators on the complex issue.

    No formal votes were taken and committee staffs were preparing to spend the next 10 days drafting language that would put in place the compromises reached. It appeared that at least a dozen of the 18 members on the panel would be prepared to back this deal. The committee plans to meet first thing in the morning on March 27. It is not yet known whether Frist will allow the panel to finish and send its bill to the Senate floor or if he still plans to bring up a more limited, possibly enforcement-only measure.

    But even if nothing scuttles the compromise between now and when lawmakers get back from recess, and if the Senate passes a bill with these elements, there would remain a steep battle to get agreement from the House. The House passed an enforcement-based measure in December that doesn't include a guest-worker program or a plan for undocumented immigrants in the United States now.

    Early this afternoon, Frist announced his intention to introduce a bill before next week�s recess that would deal with enforcement of immigration laws but will not include any of the controversial guest-worker or illegal immigrant provisions. Officials in Frist�s office say he is doing this to ensure that there is a bill ready on the floor if the committee fails to pass one. If Specter does get a bill out of committee, said Frist press secretary Amy Call, that could be substituted for the majority leader�s measure.

    The most likely scenario, said ardent supporters of immigration reform who were pleasantly stunned by today's events, is that this will end in a stalemate, only to be brought up again in the next Congress. But they say it's important that the Senate go on record as supporting comprehensive change.

    For the first time, Specter, R-Pa., who said he spent hours on the phone last night with Sen. Edward Kennedy, D-Mass., agreed to Kennedy's plan to deal with the estimated 12 million illegal immigrants. Specter would have allowed these people to work indefinitely but not get green cards. Kennedy wanted to give them a path to legalization.

    Specter agreed this morning with Kennedy's approach, provided that these illegal immigrants would not be able to start legalization proceedings until the backlog of 3 million people now waiting in countries around the world for their chance to come to the United States legally get their green cards.

    The deal reached on a new guest-worker plan says that 400,000 new guest workers would be allowed into the country each year. Under the proposal authored by Kennedy and Sen. John McCain, R-Ariz., that number would have been unlimited. But Kennedy, a senior member of the Judiciary Committee, agreed to a cap and also agreed that after working for two years, these new guest workers would have to go back to their home countries and reapply for another stint as guest workers, one that could last up to six years. But first they'd have to stay in their home countries for one year.

    Built into this compromise, however, is a chance for these workers to get a waiver and not go home based on how long they have been employed here or if they are considered essential to a U.S. employer's business.

    The plan also allows guest workers to apply for permanent U.S. residency, something not included in either Specter's bill or the other major proposal under consideration, the bill by Sens. John Cornyn, R-Texas and Jon Kyl, R-Ariz.

    Kennedy essentially compromised with Cornyn, who chairs the immigration subcommittee. The deal takes parts of each of their proposals.

    Not all members of the committee agreed with these compromises.
    Kyl said he still believed the illegal immigrants would get preference over those waiting legally in line overseas because the undocumented would be able to stay in the U.S. and work until their turn at a green card came. Those waiting to come here legally don't have that option, he said.

    And several committee members most opposed to a guest-worker program � most notably Sen. Jeff Sessions, R-Ala., were not at this morning's session.

    Brother, your idea is good but practically it is very difficult.

    Do you see a donate progress bar at the top, it took an entire month and lot of pushing to get 10,000 US$ in donation.

    People are not willing to donate, many have questions about credibility and what work is being done, some have lost entire hope and hence not willing to donate.

    It is like chicken and egg, we are asking people to donate to see change, some are saying change is not there and donation does not make a difference.

    If it is so difficult to collect 10,000 US$ a month how can your plan collect 5 million ?

    If someone is going to ask you the following questions what are your answers,
    1) If i donate 50$ what is the feedback (in terms of info, progress) that i will get?
    2) What will you do if the administration thanks us and takes the donation and gives it off to a non-profit education organization. (giving donation does not mean that they will do something for us). Then what do we do.

    Instead can we not use that money to lobby for our goals.
    Okay folks, how about this approach?

    Since a lot of people do not donate because they think it won't make a difference, how about setting up an escrow-like account, which, if it meets its target (say $5M), is used for the purpose intended.

    In case it falls severely short of the target by the due date, then everybody's money is returned without deducting any processing fee.

    Any comments?

    The law seems to have changes due to AC21, I don't think we can get any actual data of any one who got his GC after AC21 and has already converted to citizenship.

    It would be really great if IV can contact USCIS and get an official guideline on this topic.

    The original intent of labour substitution was not bad. If you understand that EB immigration was designed with the AMERICAN EMPLOYER and their needs in mind you will understand why labour substitution was allowed. It was a way for american employers to get employees in critical shortage areas and keep american industry competitive. It really was not meant to either be fair or not fair to you and me. If you understand this then it all makes more sense.
    That was then and this is now. So what has it evolved to?
    Labour substitution became a bargainig chip, for employee/employers. It was bought and sold. It was used, abused and misused and done so rather widespreadly. It started to be used mainly by Desi Bodyshoppers. In some cases for friends and even relatives, to the extent that AMERICAN employers and their employees became the ones getting hurt/delayed by it.
    So the rules were changed. Those of us who went through the traditional channels realise that those of you who took labour subs. did nothing legally wrong. Simply understand that we cannot and will not have any sympathy for you if and when something goes wrong.
    As for the folks asking people not to give their opinion. Please post in a private forum then.

    i think we probably oughta wait for some lawyer to give an explanation. i know for a fact previously you could port without an approved I-140. My lawyer supported the decision.

    But if this memo actually means that you need to have an approved I-140 prior to porting then what happens to people who actually ported w/o I-140 being approved? I don't know.....I am a little nervous now.

    Also, it'll be interesting to find out when will this memo become effective? I assume its May 30 as that was when the memo was written.

    I had asked TWO different lawyers and they were BOTH 100% sure that to use the AC-21 you needed an APPROVED I-140 not an approvable I-140.

    You are right. I was on the call, and they only blathered about some Job ADS that specify "H1 Only" or something. THey have an rss feed going on the left side of the brightfuturejobs site, and they want the Antis to post en masse about how these jobs violate their rights.

    The push is to get the Durbin bill passed. And they want to use these posts as "historical evidence" or some crap like that.

    Pretty much BS. What a waste.
    I think there were probably 10-15 people who joined. But I could identify 4/5 separate individuals. So, probably rest of them were Indians.

    Hi all,

    Mine is a different situation, i was with my employer till mid of last year and did not inform him while leaving his company and joined another job (h1 transfer) he is now saying that the vendor did not pay him some money and i have to pay that amount and he is demanding that amount for my W-2.

    He also said that he would take legal action if i didnot pay his losses ( i did not sign any document with him other than my h1b papers) no agreements,

    I am going to call IRS after feb15, but is he going to go to court?

    Please suggest me.

    You are not responsible for his losses unless your job duties were to collect payments from the vendor.

    Did you not give him any notice at all? When did he find out that you were no longer working for him?

    No IV provision is in the bill.

    For something to happen, each member needs to do their part by supporting this effort and taking part in action items. With so little support and initiative we cannot expect to match the kind of hard work DREAM act advocates have done.

    If we need an amendment, we should be showing up for advocacy day or signing up for monthly contributions, volunteer our time, or doing any state chapter work by meeting local lawmaker offices regularly in groups. Dream Act folks have built a very strong network and advocacy effort that no politician can ignore. Go through the list of things they have been doing over the past few years and you can judge how much percentage we have as a community matched that effort. This is a reality and and ultimately it will be us that are responsible for no bill being passed in the last few years.

    The community needs to do more than wasting time on the forums and trackers if they really want any bill to happen.

    I agree that a lot needs to be done and our current efforts are definitely not at par with DREAM activists however i believe that some one from the community should take the initiative and i am pretty sure people will follw (atleast members can try to encourage effected people). Lot of folks are expressing interest in volunteer activities etc on the forum and i think we should utilize the enthusiasm..immigration is definitely one of the hot topics now and i think we should use thsi oppertunity to raise our concerns and make sure that some thing gets done for all legal immigrants. I like the idea that we need to have local state chapters/regional chapters to start meeting law makers however we need to make sure that these communities are active. When i joined IV forum, i was looking for an NJ chapter but the communities i saw are inactive for quite some time.
