I had applied for H1b visa (change of status) in 2007 March.And also applied for H4 extension at the same time....I got my h4 extendion paper in July and after 2 days got my H1b Visa approved. i did applied for SSN in october,but till now my employer didn't get me any job, paystub or offer letter.
I want to go to india now so my question is can i go h4 visa stamping??
My questions are:
1) Am i out of status?? Someone told me that i will be banned for 3 yrs. Is there any possibility?
2) Should i file a compliant to US DOL abt the employer who filed my H1b visa?
I don't have any offer letter, only the I-797A paper with me.Do I need any lawyer to file complaint to DOL or can i do it on my own?
3) Will it affect my husband's H1B visa and our Future GC processing?
Please suggest me what should i do....

Spoke with Carl Shusterman today and he has requested a copy of my law suit. My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?

I feel moving VISA dates, EAD renewal and $$$ is linked.
By moving spillover till last quater..many (2007 filers**) are due for EAD renewal
If they had moved the dates, guys would have got GC and USCIS lose income from EAD and AP

This is a great suggestion, and thinking ahead is the name of the game!
I guess after Dual CitizenShip now in operation majority people might be interested in Citizenship and why not avail those benefits US passport is welcome in 3/4 of the world, for all the people who have travelled knows how cumbersome immigration procedures are in various countries.
Anyway Phase 2 suggestion of lobbying for including the the number of years of leagally living here in the citizenship count and getting an "option" of becoming a citizen when GC is issued would be great (because most people who have applied there GCs have been here atleast 5 years :))
The Guys who already have GC should also support this idea as they will be benifited by this as well.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

I'm telling you, most likely even if it retrogresses. PD will go back uptil 2004-2005. Most cases are filed after 2005 March.

He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

I sent in my OPT application on 26th of March, and it was delivered there on the 29th of March. I still haven't received a receipt and the check hasn't been cashed yet, even though it has been 4 weeks now.
Please do update me change of status. I am also facing problem with 29th March delivery.

I have to visit India in Jan. I went by the time lines listed on the website and hope they it back to me within 2-3 weeks.
I requested in a detailed letter to them if I should bump the application up to an emergency. Hope to get a response back.
( I know I might be hoping for too much here. I should have applied well in advance. )

My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.
My employer filed Labor 90 days after the job posting (6 months after I initiated the process, this is after being screwed by my previous employer for 2 years)...Labor was aproved in less than 45 hours!!!

Wouldn't miss it! Count me in. It was a great experience last summer and I hope more people will be on hand this time, this is our moment!
