Hello,
We dont see any action from core members anymore. I am watching so many threads. We expect more action items even week or 2 weeks. There are so many ideas floating around and which can get better attention if core works by putting some in agenda. I dont intend to hurt anyone.But we can do more.
I hope I participated more, but hooked up with internation travel every 2 weeks and its sucking my time.
If core is unable to do anything due to lack of money, please let us know that, and there are many who will come forward, but we need soem action that takes care of EVERYBODYS interests.

seekerofpeace - I hope they have not lost my file. I have not been able to get a concrete answer so far as to what is happening with my file.
My attorney had filed 140s for in EB2/EB3 and I hope they have not taken my app and classified it as EB3. We sent the EB2 I-140 with the AOS app so I dont think that would happen but stranger things have happened with USCIS.
Response that I got from the local senator and from what I read in the other thread you created, I think visa numbers are over for 2009 fiscal year. We will now have to wait until October. I dont mind waiting until October, but I want to use the next 15 days doing whatever I can, so atleast in October, I have some chance of getting approved.

After you apply for AP its only 1 year H1 increments.
Can you please clarify on this; If 485 is not current at the time of H1 extension and if 140 is approved should get 3 year extension. How does applying for AP change this? Do you mean using AP when traveling or mere applying of
AP will make you not eligible for 3 year extensions?

What a stupid post.
Do you really think that all EB3 people are no US-educated? EB2/EB3 is dictated by job requirements and not the actual qualifications of someone. I am graduate of a top ranked US university but applied in EB3 since my job didn't require M.S and my company didn't want to manipulate the job requirements.
I am sure there are many more like me who were qualified for EB2 but applied in EB3.
If this is the best you can come up, I really hope that this was your first and last post.

The lawsuit against PD porting makes sense from an EB2 perspective and they are right to go ahead with it. Porting your PD from EB3 to EB2 makes sense from an EB3 perspective and every EB3 should try to do it before this door closes, if it does.

Point is all want GC fast. That will not come by fighting between EB2/EB3.
It takes realization of how important skilled immigrants are to US economy.

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status?
AILA should file a lawsuit regarding these denials. They expect people to follow all H/LCA/PERM and target employers/lawyers to send a message to other people but fail to follow their own laws themselves. A lawsuit causing hardship needs to be filed. I dont know why AILA has not taken any action against this practice.

Ok, among the many replies to what i wrote, a few have been rational discussions. A healthy argument is always encouraged. However, I will dissect the above post line by line to pinpoint exactly why some people completely deserve the treatment that they get. Here I demonstrate how a healthy discussion is hijacked by imbeciles and that is why IV is doomed to failure.

For example, instead of undocumented aliens, I used the opportunity to stress the difficulties of employment-based applicants. In my opinion you are doing the right thing by reporting against your employer to DOL. DOL take their own time. But I have known a case where the employer had to shut-shop coz of complaints from former employees.
As some others have mentioned, look out for transfers with consular processing and get back here.

For me I have to renew H-1 visa every year wich will be same as EAD/AP. Each time I would go for H-1 visa I will be stuck for security clearance making me stay outside US without work for unknown number of months which is the worst experience that can happen to anyone not the grey area of AOS.
But to get EAD/AP I do not need to step outside US neither do I need to wait for security clearance and I hope to travel home when I want.
So to me EAD/AP is better than H-1visa.
If I get EAD/AP can I go for H-1 stamping?

I interpret SKILL as follows for US MS.
1. You wait for your PD to become current.
2. When your PD becomes current, you are not counted against the cap.

There is not much we can do. From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

Indian markets are in fact more controlled (by the government) than US ones. Last few years were like "wild wild west" on the Wall street under the cloak of "free markets" theory with practically no oversight or regulation of any kind which ultimately landed us all in this hole!!
It's not a wise decision to invest in India for another few years. If a controlled market like the US experiences such short comings, you cant even imagine how things will get in India. It's going to be extremely volatile and the armageddon is just about to begin. Stay away from there.
