    Hi all,


    This is my first post here, if it is not in the appropriate location please excuse me.

    My company filed my I-485, EAD and AP together.(On Auguest 6th this year) They asked me for only one check for $745.
    I was reading through a few posts and found that everybody had submitted 3 individual cheques for the same...
    Is this ok? Or did my company do a blunder.
    I have not yet recieved any receipts.

    I just had one single check...Don't sweat..

    Hello,
    I am trying to figure out if it is possible to sponsor (legal sponsorship support letter) my cousin back in India who is trying for higher studies in Canada (the letter to be shown to the Canada consulate). I am an Indian on H1B in US with Perm just filed.

    I heard that being a resident alien myself (as opposed to permanent resident) I cannot sponsor him? Is that true?

    If I can in fact sponsor him -- will that have any affect/complication whatsoever on my (i) Perm (ii) Tax application etc etc?

    He is an 18 yr old Indian.

    Thanks a lot for any advice!

    I am currently on a H1 & I sponsored my Brother's education in US last year and i think it is possible. It doesnt matter whether you are a Resident Alien or a Permanent Resident. All they want to see is whether there is an ability to pay the tution fees and support his living expenses. There shouldnt be any problem. Let me know if you need more info.

    It looks staged, the way camera moves to audience before they change their expressions, and captures the falling gum balls from the bottom of jars. Even the expressions or audience are so exaggerated.

    Also the numbers he is reporting might be cooked by himself with no proof or source provided where he took his numbers from.

    Despite that, the argument he is provinding, itself should be given to support more immigration.

    Population of all developed countries is in decline. So they are encouraging young people from other countries to support their economies. Now with so many baby boomers starting to retire, the working population of USA is not just stabilizing as he chose to say but going to decline. To support the US economy it needs young people to immigrate so that the baby boomers like himself can keep getting their social security checks in mail. So his argument is not persuasive enough to people who know better. But the problem is most people who don't know enough about immigration or economy can easily be brainwashed to become anti-immigration with this kind of pseudologic hogwash.

    I Just heard back from my Fortune 500 company that they will accept the replacement card receipt notice...so it may work. It will help to specifically ask the HR/Lawyer to check the Receipt rule.

Fong & Chun's clients travel a great deal, passing through Los Angeles and other immigration ports of entry. As lawyers to so many travelers, we try to provide accurate information about border issues. We have learned a little more about the new screening protocol.

    In the past, all citizens of certain countries believed to be supporters of terrorism would all be scrutinized indiscriminately. Cuba, Iran, Iraq, Pakistan, Saudi Arabia, Somalia, and Sudan are widely believed to have been on this list of soi-disant unfriendly countries. Citizens of other countries -- perceived as "friendly" to the USA -- would be subject to less scrutiny.

    The new POE screening procedures use intelligence-based threat assessments. This information will be applied to all persons arriving at a POE, including Americans. If border guards have intelligence that -- let's pretend for a moment -- a university-age male student from Africa might be trying to engage in dangerous activity, then the border guards would be on the lookout for university-age male students from Africa. In contrast, university-age male students from, say, Malaysia, M�xico, Moldova, Monaco, or Myanmar would not be subject to the same scrutiny.

    This new, intelligence-based approach makes the most of the information provided by US intelligence sources without painting everyone with an indiscriminately broad brush. --jcf

    Hello folks. Here is the overiview.

    485 EB3 world, applied Augut 8, 2007. ND is Oct 8, 2007.

    I just checked today and saw LUDS on my cases. NO lUD on 485 at all. (not approved) No LUD on AP or EAD. (these are approved)

    These are all approved as well.

    I129 LUd 7/13/2008
    I140 LUD 7/13/2008
    I290BLUD 7/13/2008 (I had to file because my H1 extension was denied. It was approved after the appeal. However, the status for this still shows received and we will let you know when we make a decision. this was 2 years ago. I have since then able to extend my h1 again.

    No LUDs on EAD OR AP cases. NO LUDS of any kind for my wifes cases as well.


    What does all this means. The messages are still the old ones, nothing new. Just LUDS on these cases. Does that mean that my 485 is going to be denied or that they might be looking at my case in the near future. does this mean that they may be looking for more information. Has anyone of you had LUDS on any of your old cases but not on your 485 case. I have ready somewhere that some got LUDS on older cases.

    How is USCIS wokring on Sunday. 7/13 was yesterday and it was Sunday.

    If you had an approved H1B last, that means that you already are on H1B status as of Oct 01 2006. You can continue to work in US on H1B and get it transfered also. Only when you go out of country then you will have to get new H1B stamped. I also had L1 to H1 change.

    The visa officer will surely ask you that "why did you change your status from L1 to H1" So be prepared with a good answer for that.

    At the time of filing my application I just used one address.

    Somehow I didn't know you could use Permanent address and current address.

    I'm not sure but I guess my lawyer didn't file G325 form.
    Is filing G325 form something mandatory ?

    I've moved recently.

    I want to change the address now but want to give a new address (which is not the address I moved to .)

    Should it be fine?

    I graduated in MS (I'm on H4 currently) recently.My previous degree is from India (passed out BCOM in 1999). I dont have any IT experience.

    I'm talking with couple of companies about getting a H1. What documents I need to show for H1 for USCIS? Do I need to show any experience to USCIS?

    You need to have a job offer, a LCA for the job, educational evaluation, I-129 and copies of your passport/i94 and degree. A supporting letter from the employer is also needed. No experience letter is needed to apply for H1, but to get it stamped you may need it.

The lawyers at Los Angeles' Fong & Chun are no exception, and in fact, this recent change affects some of our clients who do business in or own businesses in the Commonwealth of the Northern Mariana Islands (CNMI).

    On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:

    Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."

    Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time.
