Congress can pass a comprehensive overhaul of the nation's immigration laws as soon as this year if it prioritizes a crackdown on illegal immigration, including a new national identity card that will verify workers' eligibility, Sen. Charles E. Schumer (D-N.Y.) said today.
Speaking one day before President Obama is to host lawmakers from both parties at the White House to discuss prospects for an immigration bill, the head of the Senate's main immigration subcommittee laid out key legislative priorities, including requiring that an estimated 12 million illegal immigrants register with the government and "submit to a rigorous process to convert to legal status" or face immediate deportation.
Legislation must also create mechanisms to attract high-skilled immigrants, control the flow of low-skilled immigrants and protect native-born workers, Schumer said, without providing specifics. He did not propose an expanded guest-worker program, a linchpin of overhaul efforts that failed in 2006 and 2007 under President George W. Bush.
In laying down a road map for legislation, Schumer set the groundwork for tomorrow's White House meeting, a long-awaited session that immigrant advocates and Latino leaders have demanded as proof that Obama will fulfill a campaign pledge to move forward on immigration legislation this year.
Schumer said he expects Obama to show his "unyielding commitment" toward the goal but demanded that advocates recognize that Democrats must show the American people they believe that "illegal immigration is wrong -- plain and simple."
"All of the fundamental building blocks are in place to pass comprehensive immigration reform this session and, even possibly, later this year," Schumer said. "I truly believe that [President Obama's] leadership will be the critical difference in getting us over the hump this time around."
However, Schumer added, "the American people will never accept immigration reform unless they truly believe their government is committed to ending future illegal immigration. . . . Advocates understand the need to embrace this principle during the current debate."
As examples, the New York Democrat -- who has taken the lead in the Senate immigration debate in the place of the ailing Sen. Edward M. Kennedy (D-Mass.), who is focusing on health-care legislation -- said the federal government must achieve "operational control" of the nation's borders within a year and develop new ways to enforce laws against hiring illegal immigrants.
Schumer's proposal for a national "biometric" identification system to verify work documents -- based on fingerprints, iris scans or digital photographs -- stems from a key weakness of past immigration overhaul efforts. A 1986 law required workers to fill out I-9 forms and present identification documents, but it lacked provisions to crack down on unscrupulous employers or job seekers with fake IDs, creating a booming fraudulent ID industry.
"I'm sure the civil liberties groups will object to some type of biometric card -- it will be something with all kinds of protections -- but we're going to have to do it. It's the only way to do it," Schumer said, referring to enforcing laws against hiring illegal immigrants.

Being an eternal optimist, I am still hanging in there with a hope that things will change after the next Presidential elections.
Hopefully all the buzz surrounding alterantive energy will result in some sizeable investment by the government in technology if we have a democrat as a President. But if the status quo continues, they will be spending their money in building meuseums in kansas refuting the theroy of evolution and 'Intelligent Design' and other such right-wing manusha!
My point is, it aint over till the fat lady sings, and thank god Lou Dobbs can't sing (I hope) :p

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

They recently have introduced a rule stating that I have to stay with the company for a year after GC before I can decide to leave for another company. Otherwise, I'll have to pay back the expenses incurred in the GC process.

That said, it is not a wild assumption that a decision on a I-485 application cannot be made in 6 months, all of those who are not retrogressed get it in that time frame...
Further, since the DMV actually checks the status with USCIS... (in most states) why would they care what the document says ?
I just got back from a lengthy fight with my local and state DMV offices to convince them I'm legal to continue having a drivers license. I'm EB, in the adjustment of status stage since July 2007. DMV asked me recently for proof for status check. I took the pending I-485 receipt and while they told me it is an acceptable proof, they said they have a rule that if the document has no expiration date, they can only give you a driver license with validity 6 months beyond the receipt date of your document (with the wild assumption that any I-485 application is approved or denied within 6 months)
I have nothing against local government and their agencies enforcing immigration, but if you won't give your staff the necessary training to comprehend what legal immigration status is then it will be a disaster

Not always true, I've filed G-28 in my case, but received the AP at my residence address. Have friends/colleagues who had received AP at the attorney address. So it is kinda random. No logic behind this.

By the way, AILA reports the bill numbers for the Dream Act as follows (the bills were introduced in both house and senate)...S. 774 and H.R. 1275...it doesn't mention anything about being below 30, z visas, or being undocumented...!!!

I am a PMP certified and I know how much it makes a difference in my working now and then..
PMP is a methodology with standards if followed to its best, you will never have a derailed project or dissatified clients and management. The biggest difference I was when my VP was trying to execute a migration project and slipped 3 deadlines. When I stepped in I simply started putting up the things in place the way PMP recommends and got everyone in line and guess what, on dec 11 the migration of the complete system and application from one datacenter to the other completed. I got commendation etc etc etc .. from senior management and they said none of projects have been executed so smoothly as this one..
Thats another story after 3 months I got lay off. Anyways PMP is very very very important, its not about managing people , its all about managing the Project. Most of the guys have the misconception that when they become the PM they will have 2-5 guys reporting to them and one will be the "BOSS". Thats not PMP means, I have done Project management without anyone reporting to me, actually I was treating the team as they are my boss and keep every thing and everyone in line in terms of the Project execution. Reporting and stuff happens in the functional organization with functional managers, in projectized environment everything is adhoc. once the project is completed everything dismantles and the project management is nothing but just a tool.
You will come to know the value of Project management when one will work in 20-50 million $ projects and how PMPs help keeping everything so simple and straight.

I thought so. Life's never simple with USCIS in it :) If at that time my spouse (my beneficiary) has not used EAD and is still on a non immigrant visa (H1 or L1), can I switch to dependent status?

This is a really good initiative. I appreciate the IV core for taking this up. I have read enough stories from people on Murthy forums. I will ask people on those forums to post their stories first hand on IV forums.
