In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

Hi all,
I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

Can we ( VA, DC and MD members ) could meet up some week end to discuss Past/present/future IV/Non-IV issues. And it would be a good event not only to get to know each other and to get new people in.It would be a great if atleast one core member presides the event.

If appropiate can one of the administrators tell us how much of the funds collected thus far have been used (for whatever purposes). I am not asking where the money went :-), just basically how much is left in the Kitty now. If we are running low i am hoping we will see a spur of new donations..
Before anybody asks; yes i have contributed to IV. $600 as of now. I plan to send in another $100 or $200 by end of the month.

And also, I am looking at a big amount of money that I gotta pay for tuition, does anyone know any tax credits that we can use to reduce the burden ?

Yes, you can do part-time MBA without issues. There are tax breaks both at the federal and possibly the state level (NY has a tax break for students). The tax software will guide you thru it.

This is getting ridiculous...losing my patience
I think a controlled slow movement is good at the beginning of the year. Last year they had made, for example, EB2 India as April 2004 but they had to make it U after 1st quarter.
So, a controlled slow movement will leave to more un-used numbers in the 3rd quarter when they will then be forced to make big jumps in dates to use up annual visa numbers

I too support idea of getting Attention of Janet to clear GC backlog.
But instead of letter and FAX (protest mode) , I suggest, IV representatives should take her appointment for 20-30 minutes and explain her Administrative problems to her.
If nothing happens, We should start protest, by sending letters and faxes to gain her attention, but I believe first we do professional presentation and explain what are we talking about!
My main problem with current USCIS administrations are
- Out of order processing of cases (In my opinion case processing should be done strictly by PD)
- Lack of transparency to Visa bulletin decision and numbers.
- Better case status report on USCIS website.
Please add yours!

My fianc� is on a tourist visa and I am on a H1B visa, we are planning to get married while she is on a tourist visa? Is that okay to do so, any restrictions?
Second question After marriage can I convert her visa to H4 dependant visa while she is here, so that she can stay with me without going back? Does she have to go out of the country for this conversion to happen?
Also if she wishes to go out of the US on the tourist visa after we get married can she still apply for a dependant visa H4 to come here ? Will that cause any issues for her?
Which one is better to do, marry and apply for her conversion right away over here or should she go back and apply from outside the country?

Last week I received a copy of �Approved I-140� using Freedom of Information Act. I took almost 7 months to get requested information. Following are the steps to use FOIA:
1. Write a cover letter (Sample attached)
2. Complete Form G-639 (Sample form �Freedom of Information Act - G-639 - Form.pdf� attached)
3. Write your I-140 Receipt # in �Column 4�.
4. Important: Make sure you complete �Column 7� or you will be asked to send you application again.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.
Not according to this:
8 1255. Adjustment of status of nonimmigrant to that of person admitted for permanent residence.
(a) Status as person admitted for permanent residence on application and eligibility for immigrant visa
The status of an alien who was inspected and admitted or paroled into the United States may be adjusted by the Attorney General, in his discretion and under such regulations as he may prescribe, to that of an alien lawfully admitted for permanent residence if
(1) the alien makes an application for such adjustment,
(2) the alien is eligible to receive an immigrant visa and is admissible to the United States for permanent residence, and
(3) an immigrant visa is immediately available to him at the time his application is filed.
