Folks,
I did not face this problem because i had a physical Birth Certificate here at US and i Notarized it by American Notary ( Bank of America ) before sending for 485 last July 07
Now for my wife the birth Certificate is physically at India - my father in law is feeling nervous to send the Original by Post - you know how tough it is to get another original BC at India unlike USA where my son has 4-5 original BC for 50 bucks :)
So i was wondering if a Notarization from India would work for 485 purpose ?

My Company says that the Minimum Job requirement for the my JOB is
5 years of progressive exp in developing applications in JAVA
and there in 2 years of experience in mobile systems.
I have 6 years of progressive experience in Java, and 4 years in mobile systems. Do you anticipate any issues with an EB2 approval.
I always thought eb2 is ms/bs+ 5 years of progressive, i never know it could be bs + 5 years in core skills and 2 years in others.

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.

I applied for my Certifcate of Citizenship through my US citizen father about 5 years ago, and due to that US citizen father being an ass I still don't have it.
I have decided to just go back to England. I am happy about going back now and this post isn't about finding other ways of getting my citizenship.
When I originally came to the US I intended just to visit so I came on the Visa Waiver Program, and then decided to stay and become a citizen
My query is: When I leave to go back home will I be able to leave the US with just my passport(recently renewed) and ticket? or will I have to contact the USCIS and get some kind of letter or the like?

You do not need any agency's permission to leave US. Just submit the I-94 form if you have one.

My h1 extension was denied recently even after 140 was approved and I filed for MTR...and am waiting for the receipt number...i am in my 5th year on h1b...and i did nor apply for 485 yet..
my employer/attorney also said i can be here for 180 days...
can i change my status to F1 - study visa during this period.
My h1b and i94 expired last month....april 13
what are the other options....
any leads will be helpful..

You don't have to worry about it, if you e-file. When you e-file, the version of the forms that gets filled out by USCIS is way old. I am sure its a bug but I guess USCIS will accept it because it was e-filed.

My husband is in the same position too.He is a fellow and got a job to start in 2008 july.lc dne.i 140 pending..
Can he file for i 485....ead for a future job...this has been in our head since this evening....cant wait till tomorrow morning to ask the lawyer:rolleyes:

e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17
I have read somewhere that e-filed 140s are processed by TSC [which is a good thing for me because I have heard that TSC is lenient with cases like mine - 3 year degree ]

Hi,
My EAD card was sent to my old address, which I failed to update in time. I have been following up with USCIS for more than a month, but haven't been able to receive the card or the approval notice so far. I have to start working on Monday (Aug 11th), so this is really urgent!!
I can join and submit the EAD card within 90 days (as per the I-9), but my employer needs to see the approval letter (something which proves to them that my EAD case has been approved).
I do have the following which indicate my approved status:
1. My online status used to show that the case was approved (it said that the card was mailed to me). Now it has changed and says that a new letter (not the EAD card) has been mailed, but I won't get this letter till after Aug. 11th, my joining date. I do have a printout of the previous status, though.
2. I managed to get a letter from my university saying that my case has been approved.
3. I have the receipt notice, which shows that the case was submitted and received by USCIS.
My company still insisted that they would need a letter from USCIS saying that my case has been approved. Any advice on what I can do from here??

You don't have to leave the country if your change of status to H1 is approved with a new I-94 attached to it. However, if they approve COS without providing new I-94 then you need to immediately leave the country and re-enter with a new visa stamp.

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).

Techically, you can't use Employer A stamping as you never worked in US.
You can give a try but not before october 2010 as the employer B petition is valid only from october 1 2010.

My current H1 B expires on July 31 2011. With this I will be exhausting my renewals quota as my sponsoring company Wipro has not initiated GC process. Also when my last renewal was done, a mistake was done by Wipro Visa office. My first entry to US was in Aug 2004. After that I had gone out of US in Aug 2005 for 1 month vacation and returned in Sept 2005. Each time when we file for extensions, we give all the entry and exit dates. The Wipro visa office had incorrectly entered my first entry into US as Sept 2005 even though it should have been Aug 2004. Based on this they renewed my petition till July 31 2011. If we calculate now, it turns out to be the seventh year on H1. When I tried to change my employer this year, they looked at these details and informed that if I start GC process now, they will definitely calculate my dates and find out that I am in the 7th year of H1 without GC initiation. So they told it will cause issues and it would be better for me to leave the country after July 31 2011, wait for 1 year, sponsor a new H1 and then come back.
Is there any alternative I have here? Thanks for offering help.

what is the priority date?there is an employer who filled perm for me in october 2008 and the perm was approved.i-140 was not filled.
The employer laid me off due to bad economy. Can i still claim october 2008 as my priority date?
