Indian Government sources had said that the Bureau of Diplomatic Security had contacted the ministry of external affairs (MEA), India around the time Mr Pacheco was incarcerated for his alleged involvement in the mysterious death of his girlfriend Nadia Torrado � he was in jail from July 9 till July 26, when he was awarded bail. He is a former Goa, India tourism minister Francisco Xavier �Mickky� Pacheco was caught on the backfoot on Sunday once again as reports surfaced that the US State Department�s Bureau of Diplomatic Security had informed India that Mr Pacheco might be involved in a big immigration and money laundering racket.

Mr Pacheco used to operate an employment agency along with his estranged wife Sara Pacheco which specialized in finding employment for Goans abroad. But according to the former minister, he has had nothing to do with the agency since he separated from his wife around four years back.

Mr. Mickey Pacheco has been accused by the US Bureau of Diplomatic Security of running an international immigration and money-laundering racket. The bureau got in touch with the external affairs ministry through the US embassy in Delhi and reportedly backed its allegations with documents and details of banking transactions. The ministry then passed on the information to the CBI. The evidence is being described as substantive. According to the US Bureau of Diplomatic Security report, Pacheco had 15 million dollars in his account in the US. He recently transferred 2 million dollars to India.

My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.

Anyone here succeed in this?

AFAIK, your PD can be used across any EB - 1, 2, or 3 categories and not EB- 4 and 5. So in my opinion, you should be able to port your PD.

Hi,

I need your help on this tricky (at least for me) situation. I am a Software Developer right now and want to chanfe my job to a PM (product manager), but within the same division, same employer. Apparently the job descirption of PM (like new product functional design...) will be different from the one of developer (like new product technical design, coding...).

Right now, my GC status is: PERMLC got approved Dec/2006. I-140 was filed on Feb/2007 and still pending. I-485/AP/EAD were filed on Aug/2007 and pending.

My questions are:
1) I know the AC 21 law, say after Feb 2008(180 days after my 485 filing) and if the 140 gets approved by then too, I can do ANY job change within teh same employer or even switch to another employer, is this true? Or, I still have to stick to the similar job type(SW developer in my case), no matter within a same employer or different one?

2) Before I can use AC21, say from now to Feb2008, I know I can not switch to another employer. But can I change my job to PM with the same employer. Will this affect my 485/GC case? If so, is there any solution or workaround so that I can change my job "smartly" without affecting 485?

hi,

My spouse got her GC in Sep/2000 filed by her parents. Then went back to India to continue studies with 2 yr permission from INS. Return to US after 2 yr and stayed for 8 months in US and then took trip again back to India for 7 months. And then return back in May/2004 and still here since then.

Outline:
Got GC -- Sep/2000
out of US (Nov/2000 - Oct/2002) with permission from INS or USCIS.
Return to US -- Nov/2002
Stayed 10 months in US
Trip to India --- Sep/2003 (for 7 months)
Return to US -- April/2004

Since April / 2004 here in US.

based on this stasts we my spouse apply for citizenship.

USCIS work sheet eligibility says >> 5 yr GC ->> If not out for 30 months in last 5 yr (true) >> No trip out side of US more then 1 yr. (FALSE - If so execpetion -- took permission - true) >> good moral >> etc., >> APPLY FOR CITIZENSHIP.

But when read the eligi. requir. its says absence more then 1 yr cancel all previous contin. of stay ??? confused with this both understanding.....

I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

My impression was that I was obliged to work for that exact position(the one on the labor) to prove the 'intent'.

Hi pkrg21,

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?

I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

An H-1 petition filed by a new employer should have no direct impact on your AC-21 GC process. Because you are not currently in a valid non-immigrant status, you are not eligible for a change of status in the US. In any event, the petition would not be valid before 10/1/2010 assuming the employer is not cap exempt. So, you would have to travel out of the US to apply for the H-1 visa to be stamped in your passport. To be safe, you should make sure you have a valid AP with you before travelling just in case there is a problem ofr delay at the consul.

Company "A" had filed my H1B transfer after I accept their offer. I signed the offer letter
In offer letter no where it is mentioned that if I leave company , i have to pay H1B transfer expenses.
Also It is clearly written without any reason , time either way can terminate job. This is below from offer letter..

"I have read and accept this employment offer. I understand my services under this agreement will begin with the successful transfer of my H1B. I understand my employment is terminable at will, i.e., and either company or I may terminate the employment relationship at any time, with or without cause."

Now , I have a better offer ,I am not joining that company .
They are asking me for H1B transfer expenses.

Company is asking "You signed and agreed to become an employee, however you never even started working here to begin an employee/employer relationship also you keep delying your joing time..It is clear that the delays were a stall tactic and completely dishonest, which any court will agree with."

If I am not paying it, they are going to take legal action ..

Please let me know your thought or any lawyer can help me in case company files legal action and what will be charges

I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.

My 9th year H1B will expire in two days. My I-140 is still pending with TSC. I've sent my papers for H1B renewal. Hoping to get an extension till March 2010.
Hang on...I-140 approval is the key for 3 year H1B extension and 2 year EAD extension.
