My immigration department had my all papers since Feb'07 but applied for LC only on 6/25.... whenever i used to enquire about it just one line anwser ... "it is in motion and will let you know progress of same"
When My Director(he is US citizen) requested for information for my case no reply whatsoever and finally they applied my LC.. even my director gave them clue of one pre-approved LC from my group with priority date of Dec'06(matching with my skill set and education) but no reply and on 17th morning sent reply that LC substitution can not be done now ...

I do not know if I am doing something against the rules of this forum, please excuse if I am. I am just a father trying to do something to protect his daughter; but I know that there are many other children who are or were under similar circunstances. I am not a lawyer. My wife, my daughter and I went to talk to our Representative Moran and our Senator Webb, but they are interested in numbers, cases, especially Virginia residents; but I think that this is something national. We (my family, I and anyone who wants to join us) can go to the office of the Leader of the Senate Majority or the House or to the office of any other committe leader and give them a letter showing numbers and cases, real families that are suffering and requiring them to do something about it. If you agree, I would suggest to prepare a small database with all the cases that we know, then prepare a letter and send it to the Congress leaders.
I think that we would need the following information:
1. Your Contact Information: (Email at least; First, Last Name and Phone Number ideally)
2. State Where You Live
3. Your Employment-Based Category (EB1, EB2, EB3, Other Worker, EB4, EB5)
4. Your Country of Origin (CHINA-mainland born, INDIA, MEXICO, PHILIPPINES or OTHER)
5. Your Child's Date of Birth
6. Your Case Priority Date
7. Date Visa was available
8. Date DOL approved your Labor Certification
9. Date I-140 was sent
10. Date I-140 was approved
11. Anything Else You may Want to Add: (like current status of your case)
Please let me know if that is ok for you, we can use this forum to collect the info or I can provide my email account or phone number, either way is ok for me. Thanks for your understanding.

Thanks Sandy. Appreciate it.
Does it mean that now if the denial is appealed by my attorney, then my case will go to some Backlog Processing Center, or it'll still stay with Atlanta National Processing Center?

I have received messages from people who have been here around 10 years without a GC. I wonder how common this is. What do you think about proposing a "fast track" for people who have been here legally for more than a certain amount of time?
Thanks for your efforts.
My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.
These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.
Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.

Also,
How come no one in your company B asked you whether you are married or not and whether or not you need H4 filed for you spouse. Same thing about company C. Either of these companies' HR or immigration lawyer should have asked you about dependents and spouse?
I dont know but even the smallest of consulting companies dont make this kind of mistake and they would remind you if you forget. My company's lawyer is quite lazy and slow but even his paralegal asked all the right questions and got all documents needed and didnt forget stuff when filing for various things.
whn i filed my transfer with company B..my wife had not come to USA and my lawyer didnt tell me tht after she comes here i shud file for her xtension also..
Whn i was transferred to Comp. C..thats whn the lawyer pointed out my wife's i 94 was expired which shud not have happened..

So what, people in other lands can learn these laws and still do some work of
lawyers/paralegals:
http://money.cnn.com/2004/10/14/news/economy/lawyer_outsourcing/
a lot of companies are already getting their patent filing work done by attorneys and paralegals abroad. Wont be too long before your I-485 filing is also prepared from outside the US :)
My question is what will the attorneys and para legals do in the US, if they don't find sufficient cases to sustain their operation? What they studied here is not portable for other countries like software.
Thanks

I just learned about this initiative today and immediately joined. I think it is a great way to pursue our goals and this iniative for each member to invite atleast one or more others to join the community is a step in the right direction. Keep up the good work Neelu! It's my turn to bring awareness of this effort to some of my other friends who are in the same quagmire.

Is it just me. Has anyone noticed all these new threads and posts by new members, their 1 or 2nd post and they are bashing the Indian consulting firm. They are asking for names of such firms to file a lawsuit against them. The timing of these posts is interesting with the new Senate bill S.1035, which wants to make the H1-B system unworkable by citing the example of such Indian consulting firms. One of the pretensive solution of this bill is to stop such exploitation by Indian consulting firms.

"Some might wonder why we participated? Well, how could we give up on a chance to make history and truly understand what it means to live in a democracy. Its not about desperation for a green card, its about fairness and dignity. We believe that we have the right to a fair, open and predictable process and anything else is an affront to our dignity. We believe that the system is broken and can be changed. But change to the system will not come overnight and it will definitely not come with us keeping quiet. So we got out and did what we knew was possible - get the message out, propose solutions, meet congressmen and appeal to people's conscience.
In participating in this movement for change, we realized something else that we would like to share. We realize that the struggle for a fair immigration process is but a process of change just like struggles against oppresion and prejudice of different severities. The only difference is that its a question of dignity and fair process versus segregated facilities and disenfranchisement. Accept one and you accept the other. So if we wonder how the world could have every been a certain way in the past, we don't have to look beyond ourselves. Honest and well intentioned as we might be, if we cannot stand up and say something about something that affects our rights and freedoms as individuals, we are saying that we are OK with all that is around us.
thanks to all who offered support! if you are still on the sidelines, do get involved! Our success depends on all of us making a contribution!"

[QUOTE= From 2005 onwards people are actively looking for EB2.[/QUOTE]
And that is the problem with new bees. They do not have knowledge about the prevalent effects of past occurances and generally people decide about filing by hearing 4 frineds and reading 3 suggestions from the forum. In my opinion, assuming USCIS will work like the way it is working till now, it is dangerous for somebody to apply a "new File" under Eb2 category. Again this is based on assumption that everything will rmain the same way. If tomorrow there will be a drastic change in the law like 800000 total EB visas per year then things will be changed. If I would be 2007 filer, I would file under EB3 category.
