USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.
It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.

Looking at your RD reminds me of a friend of mine who has a I-485 RD of Dec 2004, but he is in EB3. Unfortunately his NameCheck was not clear even in the July 2007 fiasco, the reason he is still not green !
He and his wife recently sold their house and everything else and left their jobs and moved back to India! Enjoying themselves there while their I-485 application papers turn yellow !
You paid 68K for legal and immigration fees... that is steeep man ! I wonder how...

IV core is doing a great job. One can't ask more of these great guys (and gals)!!
Although I support the idea and my spouse would be benefited by it, allowing H4s to work is a whole different ballgame and way more controversial than the current IV agenda. Your spouses will be able to work once you and they get EADs (although I know you will have to renew annually)...this is way more reasonable.

I like majority of others who came here on H1 with genunine intent of settling down should work toward common goal of easier GC processing and not support outsourcing idiots esp L1s who is nothing but shipping jobs overseas and making a field (eg IT) minimum wage pay. Just look around how much TCS pay .
COmmon goal of us is easier and humane green card processing and to work towards the goal to stop blatant abuses in the form of L1 (and some H1 )

How many IT jobs are there in Canada (assuming most of the members in IV are into IT)? Canada Alberta program increased processing times to 8 months now and it excludes federal processing times. Federal application method takes more than one and half years.
So its good that you have chosen an alternative and worked out well, but your alternative many not be an alternative or not even option to all!!!

Hello,
With hard 7% limit per country; our numbers within EB category are at 10,000 (it's not a huge number even if we apply 7% on EB+FB).
There are at least 250,000 people waiting on GC from India alone, at this rate it will take 25 years.
Am I wrong, I really hope I'm terribly wrong.

So far what I have seen from various forums, looks like its a standard RFE for most of the cases.
Asking for updated G-325A(Its an updated form little different than what we submitted during july 2007) and EVL.
Just submitted my evidences today to USCIS to the RFE I received on March 19th. Hopefully it may mean that all other evidences are fine...like BC, MC and Medicals....

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

No. that's not the point. See, you can't force people. If X is "recurring contributor" now, he has done that willingly and that is the best essence for us.
As long as people support the cause and organization "Willingly" we will have infinite horizons to grow. The moment you bring "Burocracy" in, ultimately momentum will die.. may be slowly or quickly. Historically, IV threads are the major attentive media to declare the existence. We should not kill that with any enforcement of "Paid membership"...It is always hard to wake people. If that would be easy than nobody would have used the word "Struggle"..right:). On other hand yes there is a dier need of increasing financial strength exponentially and that too quickly is at high priority. We need to think and find other ways and resources.

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that�s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?
