If we are claiming to be best and the brightest having high skills and inventing then it is EB1 and EB2 mostly. By law EB3 is mostly for people who have Bachelor degree and hardly any experience in their field to claim as EB2. It does not matter you are masters from Harvard but by law, if your job requires just a bachelor degree then you are doing basic work at lower management. Legally EB3 have no case if they claim to be best and the brightest inventors. All doctors get EB2 or EB1. All managers with advanced degrees get EB2. All Scientists and PhD holders get EB1 and EB2. So EB3 is mostly people who are low skilled programmers, people in professions doing lower line work or people who despite having higher degrees are doing jobs that do not need advanced skills to be the brightest folks immigrating in USA. There are some exceptions of people who are screwed by their lawyers and employers by forcing them in EB3. These people should fight with their lawyers and employers or change their jobs to EB2. EB3 do not have a strong legal case to fight for EB3 if they claim to be best and the brightest. It is very humiliating but you like it or not EB3 is grouped with EB3 Other Workers that are waiters, janitors, construction workers, Farm workers etc.
So if we PORT for EB2 then we also become best and brightest?

I have been a trader for thr last 3 years. I am more of a swing trader than a day trader... But I do a lot of day trading too. I believe trading is the only way to make money in the stock market... Chintu has started an excellent topic here... It does require tremendous amount of discipline, patience and hard work and its definitely not for the faint hearted... Chintu is covering lots of things here, but the on;y thing I would like to add is learning about macro economics... that will help you spot major trends in the market... Also, apart from regular stocks there are double and triple long and inverse etfs... For eg FAS and FAZ... These are triple long and short etfs for the financial sector. These are leveraged three times, which means these are on full dose of steroids... If market goes up 10% these go up 30% and vice versa... so you can make or lose a lot of money in a very short time... Happy trading!

I wouldn't pass such judgement on immigration-law.com. They've acknowledged the mistake. It's not like no one makes any mistakes, it's how they acknowledge and move forward.
Immigration-law.com has made many many many mistakes especially considering the fact that they are lawyers. Lawyers by profession hardly ever make statements, since their profession is to make sure what they state is 100% accurate. They are more like a news sensation organization, so please there is no need to defend them. But people like us that includes me want this thing to work so bad that we go to their website for our vested interest and to give us some hope. They are more like a blog than a legal web-site.

Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.

I don't see the point in dissuading people like this. This is an example of someone who was able to adjust an important appointment because he thought that it was equally important for him to be at the rally to show his support. Ofcourse there are some things that one cannot adjust, but is it really true of everyone?

Its great that someone is actively looking into this, but will the whole 'security' issue backfire if USCIS decides it would rather waste the visa numbers than getting into this kind of mess in the future by processing everything swiftly?

Appreciate your efforts on this issue. I think it is better for every one to print the format with case numbers and sign it and scan it as a PDF and send it to a single person, may be a admin or to one of us. He or she needs to put all the case numbers on one sheet to address to DOL and provide the signed letters as supporting documents. All signed letters can be put together as one file for an attachment to be sent as a e-mail.
I can do the ground work if needed. I also sent a e-mail to my attorney asking her recommendation for her course of action. Let us see what she comes back with.

I am sure there are quite a few people who are following this thread; but are in two minds about being able to complete the race. If this happens to be you, then try doing this for starters.
5K = 3.106 miles.
So get into your car, set your odometer and drive exactly 1.55 miles and back. Then walk up there and back and time yourself. Not everyone can run; but even if you have been leading a sedentary lifstyle, you should be able to walk this distance in 45 minutes....even if you are short :)
If you find yourself struggling to walk 3 miles, believe me; you have bigger problems to worry about than a green card!

I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.
I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.
We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.
Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.
So Keeping it simple - 5 yr federal taxes, MS or higher in STEM, 3 years after GC - you get citizenship (all of these has precedents)

Have your medical appointments completed. Medical appointments can back up quite quickly. Therefore we urge people to complete their medicals.
Send in your documents to HLG. HLG�s I-485 Step By Step Guide has a list of documents that we need for all I-485 filing. HLG will not begin preparing the I-485 at this time, but we still recommend that you send us all of the items on the list.
