HLG has confirmed that the CIS is not returning I-485 Applications back to those who filed I-485 during the first week of July. This is leading many to speculate that the CIS may reverse course and re-re-amend the July Visa Bulletin; whether the Visa Bulletin actually reopens remains to be seen. HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.
What does this mean for foreign nationals who planned on filing I-485s in July 2007?
HLG recommends that all foreign nationals who planned on filing I-485s in June take two actions:
Have your medical appointments completed. Medical appointments can back up quite quickly. Therefore we urge people to complete their medicals.
Send in your documents to HLG. HLG�s I-485 Step By Step Guide has a list of documents that we need for all I-485 filing. HLG will not begin preparing the I-485 at this time, but we still recommend that you send us all of the items on the list.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

yeah it seems that reporing of 485 approvals has slowed down a lot, i rem seeing 10 > a day a few weeks back. The sadest thing is that that one user who reported getting approved today has a PD of 07/15/2004.... i thought they were approving 05 cases.

I am having hard time procuring a Non-availability of Birth record certificate(NAC) from my home city of Delhi. Is there a way around this? I do have affidavits from my parents.
This NAC is holding up my application. Can we submit the document that you get in 10th grade with date of birth instead of the NAC. The NAC process takes a month or so, Police check...local magistrate orders the local municipal corporation et al.
Any suggestion will be greatly appreciates. Sorry if this post is in the wrong thread.
Get a new BC made, and attach 2 affidatvits. I was able to get the new BC in 2 days. Though 'coz I was bon in a Hospital in Delhi, they could locate my records and the new BC specifies that Date registered was 28 years ago. It costed my parents about Rs2000, they got hold of a dalal in from of the NDMC office and he was able to get everything done. According to them there are tons of people standing there getting these things done.

I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.

Friends,
I know once I 485 is filed and I 140 is approved after 6 months you can move to a simlar job.
My question is what you get laid off after 6 months of filing I 485 but you cant get a new job immediately, what if you get new job only after 2-3 months gap - what are the reprecussions ?
Also is there concrete guildlines on what same or similar job is ?

This provision allows individuals who are out-of-status or who entered the U.S. without being inspected at a designated INS port of entry to adjust to permanent residence, if they are otherwise qualified. In order to benefit from this provision, the individual must be the beneficiary of a labor certification or a family petition filed on or before April 30, 2001. For this reason, extraordinary numbers of cases were filed nationwide on or slightly before April 30, 2001. According to the information released by the Maryland DLLR and other states, local DOL offices did not receive additional funding in connection with the LIFE Act filings.
With respect to case processing, the DLLR reports that they are processing RIR cases received April 5, 2001 and non-RIR cases received March 8, 2001. Of course, these processing dates will be further affected by the glut of cases filed on or immediately before the LIFE Act deadline.
These time frames are similar to those experienced in most other states that are attempting to catch up on the huge volume of cases filed on or before April 30, 2001. We will share information with our MurthyBulletin and MurthyDotCom readers as and when released by other state labor agencies.

I fully agree with this idea, but unfortunately this has been discussed for a long time now but none (including IV CORE) seems to be interested in pursuing this further, although we all know that this has higher changes of approval. And I am sure even the folks with no MS from US will support if for simple reason that it will help them as well if backlog and crowed is reduced by whatever means. So I assume we all (US Degree Holder or otherwise) will support this -- still no actions..
I agree with this 100%, BUT we (US degree holdeers) have to understand that in the GC aspirant community there are tons of people who came in through "desi consultnats" (even this word makes my blood boil), who will never agree with this or support this. Classic Indian mentality, one crab pulling the other back in the basket.

eastindia, you are correct. GCPerm sometime back was on a "flower campaign" mode and was asking all IV members to send flowers so that USCIS will approve his/her green card ASAP. now that, it has been approved, the user has switched to a citizenship campaign mode.
GCPerm, a piece of advice. When a person volunteers for a cause to help others, the person should never think of how the result benefits them. If you look at IV members who are advocating for clearing this green card backlogs, by volunteering for the cause, they are not looking at how it benefits them, but how they can pave a way for future applicants.
When it comes to citizenship it is more difficult as I have personally seen people who are willing to continue with green cards for more than 20 years than taking up US Citizenship because they are more emotionally connected to their birth countries.
Anyway, note if you are sure of the fact that you want this campaign to continue even after six years of you starting it(by then you can become a US Citizen), then you should be promoting this.
Example, Aman Kapoor who started IV, got his green card and still fighting to clear the green card backlog mess.
Hope you understand the point. Nobody wants a leader who won't be able to continue once their ulterior motives are attained.
Guys let it be selfishness... but ultimately if we win, it is a win for every one... I am living in this country for more than 11 years but still with an EAD status.... We are spending most of our life time as an ALIEN. Think yourself which is better...

My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?

They said they would mention the same in 693 document that the test were not done because she is nursing a baby. But this doesnt mean that she is exempted from immunizations and TB test. She would need to come back and do the immunization after 3 months and the doctor would keep a record of it and INS would varify it later with doctor about the test results.

We have 2 threads talking about the same topic.. contribution .. While it's good to see both threads getting lot of hits, I suggest that we merge both of these threads so that we all get on the same page.
