CHECKLIST OF DOCUMENTS FOR ADJUSTMENT OF STATUS
2.*Copy of Birth Certificate of Employee and ALL Dependent Family Members
(Please provide translations if not in English)
** If NO birth certificate is available then a Non-Availability Certificate MUST BE SUBMITTED with Affidavits of Birth, Executed by two immediate family members who were 5 years of age or older at the time the birth took place
(Please see attached sample)
*** If a birth certificate was recently issued, then it MUST BE SUBMITTED along with Affidavits of Birth, Executed by two immediate family members who were 5 years of age or older at the time the birth took place(Please see attached sample)
*** Please also include U.S. Citizen Childrens Birth Certificate(s)
10.Copies of ALL I-94 cards, I-797 Approvals (H-1B & H-4s), I-20s, and EAD cards.
radhagd, thank you for the information.
Couple of questions to all gurus:
Is there any time limit to say birth certificate is recent? I got my birth certificate in Jan'07, trying to see if i need to sumit the affidavits?
Also do we need to have copies of all I-94 cards since the first time we entered US? Looks like i don't have the I-94 copy which was issued when i entered in 1999 for the first time. In that case what would be the solution?
Thanks in advance for the feedback.

I live in Los Angeles and sent my paper-based application to Nebraska. it reached on May 01 but no reciept or check cashed yet.
I know After reading this forum that I should have mailed to Phoenix lockbox instead on Nebraska service center.
Anyone in the same boat?. Do i need to file again or wait for USCIS to forward it to Phoenix lockbox.

I work for a big computer company and my company policy is that i work from home (else i will loose some company benefits if i work from company's office).
I have a copy of my Labor Cert forwarded to me by Dallas Backlog center. Here is what i see :
On ETA-750 Part A: Item 7: "Address where Alien will work" = Illinois
On ETA-750 Part B: Item 7: "Address in US where Alien will reside" = Virginia
Given the above facts, and given GC is for a future job, What are your thoughts on my questions below?
1. Do i have to go back to IL or VA before I-485 petition ?
2. OR, Can i work from anywhere, like i do today, as my company has home based/iWork policy and apply for I-485?
3. After i go back to IL where my Labor was approved and after 180 days, can i invoke AC21 to move back to CA/other states for SAME employer?

Speaking for myself, I'm not seeing the value.
I see IV right now going off and tilting at windmills that will have little effect. Stuff like the I-485 without current PD for example, will serve to both alleviate the immediate issue of backlog, and make those responsible less likely to actually fix the problem, all while creating a permanent under-class of immigrants who will spend decades waiting for their permanent status.
So...when I see them advocating for things that will make a difference, I might consider contributing at that time.
Dear Sir, You are EB1C, chargeable to CANADA..you should have your greencard sooner than one can say Mississipi..or Schenectady..or Connecticut...or whatever.
I am not accusing you of apathy, but you may not be able to understand the anxiety, pain and frustration that a person who is an EB3 or even EB2 chargeable to India or China. People in such a situation will tend to grasp at the straws.... if not the whole bale of hay.

USCIS does not differentiate US or Indian degrees.. Yes US degree has its own advantages... It more than just LEARNING...
Education is a bigger word than learning... Institutions can impart learning only... You can be highly learned with big degrees... still not educated :-)
Take a chill pill friends... Degree is important to USCIS like MPG (miles per gallon) to Car.. as its a basis to compare different entities :-)

why do you say so??
Till early part of 2004 or latter part of 2003, most of the Indians applied EB3 very few applied EB2. After 2004, it was reverse. I doubt any one appled EB3 in 2005 0r 2006.
If EB3 stays continously in 2001 and EB2 in 2004 (there is 3 year difference in cutoff date between EB2 and EB3 now), the guys with EB3 PD 2002 and 2003 will convert to EB2 by applying new 140 to transfer PD. This flow will balance the cut-off dates. Eventually it will reach a common ground or a break-even point.

I understand the frustration. My husband has an Oct 2003 PD-EB2 ROW. His friend who applied in June 2003 in EB3 has a GC for 2 years already. When the backlogs were introduced in march 2005, the regional office was certifying cases one month older than his. I suggested to apply for PERM, but the lawyer said he'd lose the PD and it's not worth it-it will get certified soon anyway. That turned out to be January 2007. In march 2007 we finally applied for 140/485 and I was happy to notice cases in EB2-ROW were approved in as little as 2 months. My hopes were high, but not anymore.
I can't describe how happy I was for one of my friends that applied on July 2nd. I told her today's big news and she was in heaven. But at the same time I realized that it's not very good news for us. The delays will be now huge.
So people stuck in BECs, you have my sincerest sympathy. My thoughts will be with you and hopefully something can be done to help you.

If nothing else, this attorney deserves a medal for at least communicating with his clients.
We'll believe what we want to believe. Since the grand goal for many of us here is to get an EAD for dear spouse, here's some contextual Balzac: "There are no small matters for the heart. It magnifies everything. It weighs the fall of a woman's glove and the fall of a 14 century old empire on the same scales. And almost always the glove weighs more." (Apologies if I don't remember the words exactly. It's translated, anyway.)
Boy did you express it well or what? Here is the translated quote I found "There are no little events with the heart. It magnifies everything; it places in the same scales the fall of an empire of fourteen years and the dropping of a woman's glove, and almost always the glove weighs more than the empire'. Could not have expressed it any better.;)

Honestly I cannot see much wrong with Congressman Pences point of view.
Unless you are an illegal who is looking for a free ride on the US immigration laws, you have got to consider it fair. Especially if it is combined with some sort of expansion of legal immigration, a fair minded individual cannot really quarrel with it.
Only problem is that it will cause those coming after a few years legally to get caught up in a Tsunami of applications and probably will be unfair to them, but ATLEAST they would be aware of what they are up against and will choose to come KNOWING that.
Immigration to the US is not a right and many of us are suffering a lot to play by the rules so our children have a bright future. Our talents are being utilised at less than their full capacity to serve a bigger purpose in this land. We are waiting patiently. Someone who cut in line should not be given rights and priviledges that we have suffered so much to get by doing the right and honorable thing.
According to this new plan the illegals will learn to know that a green card is a LONG PAINSTAKINGLY FRUSTRATING process just like all of us have learnt.
I am happy that despite their breaking the law they have a chance to atone for their mistake and still EVENTUALLY get the green card, perhaps when they are old and grey but eventually. Hey I have sprouted many grey hair in this endeavour myself!
I think this is fair and balanced and just might be able to put this CIR beyond the goalline. God knows the current legal immigration system needs some reform.
... the problem however is that the laws and procedures of the land do not care if you are suffering to do things right which makes it an UNFAIR system.
