When we 50+ people send one neatly drafted letter...I am sure it will draw considerable attention. Ron is willing to help us. I am not sure if we need to hire him for this. I am considering transferring my visa from H1B to H4. If in future I need to transfer my visa back to H1B, would I be in the 65000 quota even if I travel to India or outside US after transferring to H4?

We are spinning in circles here and it is like reinventing the wheel. This is THE grassroots org �THAT you want to set-up. already set up to achieve exactly that � YES, YES �We want Congress to introduce a bill to reduce backlogs. The core goal of IV is to have a bill that has our provisions. That is exactly what this organization was set up to achieve. You seem to be a newcomer to this struggle. Have you followed IV from 2005 Dec when a buch of members got together on some other forums and watched helplessly as good provisions (that were meant to allievate our troubles) were taken out at the last minute from a bill during debate.
Since then we have tried and tried and frankly have matured enough to understand that the politics of the immigration issue is complex and any standalone bill �just for us- has no chance.
Our provisions have to be clubbed with all the rest of the minor and major groups � that want reform. There is the nurses lobby, the doctors, the illegal lobby, the dream activists, and many other fringe groups, they all want their issues to be addressed. The anti-immigrants are a big opposition to any small relief that comes up in debate. NOW- We have learnt that we need to work with all these groups, form alliances and lobby hard to get a bill that has more support.
If you go meet with your lawmakers you will understand that our issue is a miniscule little piece of a bigger issue of Immigration. And different varying and sometimes opposing groups have to be accommodated. The politics of immigration is convulted with different factions of the society wanting different things � Our little issue is straightforward and we enjoy a lot more support for our provisions, unfortunately we were clearly told that we have to be clubbed with these other groups when it comes to seeking a bill for reform. We are being held hostage also by the Hispanic lobbyists, that feel that if smaller bills come up and are passed, there will be no apetite for their bigger issue of legalizing a big core of mostly Hispanic illegal immigrants.
FOR A RECAP- after this administration came into office �Jan 09- We had hopes and were promised that CIR (Comprehensive Immigration Reform) will be taken up, if that fails then smaller bills will be allowed to be taken up. If you have watched the developments carefully �There was never a time and a lot of groups including IV lobbied and lobbied hard to be heard and to get a bill but- the legislative calendar with so much other priorities had no space for any immigration bill this year. After the healthcare bill, Nobody has had any energy for a big controversial bill.
Long story-short is YES, we want a bill (either clubbed with others) or amendments inserted into a bill- But have not been able to get it done.
The reason for this failure is us- IV Members. We have not met our lawmakers in the numbers that are important to make an impact. We have to do it every month- building pressure to get a positive sympathetic response. Now some members (including yours truly) have gone and met our respective lawmakers more than 6-8 times in the last year, but that is again not enough, that is just 20-25 odd members compared to total IV Strength of 40,000members. It has to be an ongoing effort, just like the dream activisits have done, they meet with lawmakers regularly, highlight their frustrations and are open to media �giving interviews and keeping their issue alive in the limelight.
IV has come up with specific recommendations for what we would like to see in a bill/s for our community. IV actively analyses any bill that comes up or has a chance to come up for debate. If you want to get your hands on that document, contact Anu or Pappu and ask for the IV_Advocacy package.
We do have a paid lobbying firm that represent our interests and educates lawmakers. This is not enough, because during debates lawmakers behave as if they do not have highly skilled immigrants in their constituency and so do not have to pay attention. This is mainly IV members fault, since we have not been able to visit lawmakers offices in the numbers that we should. Our members need to show up at lawmakers offices and educate them. Tell them you live in their constituency and represent IV so that when the lobbying firm does their work, they are paying attention and our voices are not ignored or drowned.
Individual members need to be open, honest, and courageous enough to talk to their lawmakers and media about issues we face. Just crying and debating on IV's website does not help. Talk about introducing a bill for us to your lawmakers � not here on IV.

I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

I may be wrong, but I had different impression. If officer felt that GC can be given in one year they issued 1 year EAD, other wise 2 years EAD. When I got 2 years EAD, I was not happy about it.
But several things go wrong and people might not have got GC despite getting 1 year EAD. I feel that people getting 1 year EAD must have every thing ready, just waiting for their Visa Number.

There isn't much to be calculated for EB3. With spillover practically non-existent for EB3, we can easily calculate our wait times from pending inventory data published by USCIS.
The only positive development is that 245(i) cases that has been eating into EB3 quota is done with. So dates are no longer stuck at april 2001. We should see a slow but steady movement. Unless some spillover happens once EB2 has become current/close to current, I don't see much hope without legislation.
For those folks who think of not participating, consider these facts. Aman Kapoor and other IV core folks who already got their GCs are still working for our cause. There are lot of EB2 members among IV volunteers who work for this cause. We shouldn't just think of this as our personal issue. Rather we should consider this an issue for the entire EB community and work to resolve it.

I think we should make a list of things we lost and found in D.C :)
The amazing thing is We Found all the things we lost. I found the same pair of glasses Twice! The owner managed to lose it again in the situation room and I found it again - I think he didn't like the glasses :)
Chargers and ties were lost and found. I think after working 3 days straight, without much food/sleep and thousand and one things on our mind - we too were lost :)

We all had a sigh of relief when we saw the new labor certification process (Perm) and were promised that it will be much faster and smooth. Thankfully they have kept their promise, for the most part, except for the cases that get audited.
The cases that are 'randomly audited' have been pending for months and months, some cases () have been pending for over an year and there have been no response from DoL what so ever. I understand that a year does not sound bad especially to those folks who had their labor approved through the old process but these days the labor is getting approved within 50-60 days (average). It appears that the DOL (Atlanta Processing Center at least) does not bother to look at the documents once the audit has been replied to.
Although I understand that not everyone uses and some audit replies may have been replied sooner and were never reported to but you can get the idea just by a sample of the cases that were audited, and see that they have being neglected, ignored or appears that they are no longer considered for further processing. I have seen instances where the lawyers have retreated the application in the audit and filed a new application (a gamble) hoping that it does not get audit this time around. But not sure how that turned out.
If you visit the Atlanta Perm section on you will see the people's misery I mention here. In fact, I am sure that there are number of IV members who are going through this aggravating process but are silent becuase they know that can not do anything. Even lawyers have shown the sign of disappointment to this hopeless condition.
So I ask you, Members of IV, to help us and suggest something that (we) can be done to bring this to the attention of some sort of authority that would help trigger the review of Audit responses.

For filing I 485 I know you need to submit birth certificate and marriage certificate. Do both of these have to be originals or copies are fine ?

What's the procedure to create or raise a SR?
I opened a Service request for my case and got a reply last night, saying 'you cases is assigned an IO offices. Please allow us 60 days to make a decision ....'
I called the number on your I797 form and rep asked me, if I had any activity on my case in last 60 days. I said No so she opened a SR.

just an update from my end. I had sent my EAD renewal application to NSC by mistake when it should have gone to Phoenix lockbox. My check was cashed today from Phoenix center, so looks like NSC forwarded my application to the right place.
