Thank You IV for providing us with this platform to get our voices heard where it matters the most. Go IV!
The phenomenal experience of actually doing something positive to solve our problems is - but I am just acknowledging the great enthusiasm that was vibrating with our members - they realized the gravity of the situation, the opportunity that was within their grasp and wanted to make the best use of it. Hats off to you guys!!
IV realizes that our strength lies within our members and their dedication - both in terms of participation and funding. And if there is one thing that almost every single participant took home from the event is that - we still have a long way to go and we need far more support and participation. .
Thank You needhelp!, Devang, StarSun for summarizing the DC Experience. Each one of us that went to DC came back with a more positive outlook, the satisfaction of doing something good. I will write in detail my personal experience, but in a nutshell- The camaraderie, the enthusiasm and the tireless effort that some members put in is just commendable.

Sad, but true, the substitution labor are utilizing the visa numbers a lot.. Not sure if any thing can be done @ this time.... There were lots of new people filed I-140/I-485 utilizing substitution labor in July / Aug 07 as the LC substitution was sunset after wards... Though it is legal :confused: they could have made the PD, they day I-140 was filed, since they allow to retain original PD, now people who really waited are forced to wait even longer.... Now that the program is sunset and also many people already jumped the line, do not see any advantage in complaining about it and expect no administrative reaction to this as labor sub no longer exist... Only solution to retro... is unused visa recapture / increase visa number / exclude dependent / etc... none of these can happen without intervention from congress.... which required very intense lobbying... which in turn requires $$$$ ... and more participation and contribution from the members seems to be the only option that could help all... If you don't help yourself.. no one would !!!

If somebody says EB3 filer is inferior to EB2 (in a way), then it is ridicules. Being said that, nobody has asked to them to opt for EB3, it was just the situation they were in when they started their GC journey. Let it be their educational qualification, experience or job requirement, they opted to go with EB3 with full consciousness and also due to some compelling reasons. If EB2 dates are moving forward why EB2 filers needs to be blamed / targeted for that? This doesn’t make any sense either.
Also, now nobody is stopping them to convert from EB3 to EB2.
Let us just stop this EB2 Vs EB3 crap and do something constructive. These kinds of fights will not take us anywhere.

I heard from a friend who has a brother working in one of the lawyers affiliated with the AILA that USCIS has issued an internal memo to "go slow" on all EB 3 petitions including EB 3 I. That is very confusing to me given that EB3 I is U on the May VB. Has anyone else heard about this? if so can the IV core take measures against this discriminitory move.

She had her delivery in a hospital which automatically assures adequate care for the child (paid for by the good citizens of Maricopa county, i should add).
As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications.

I can't wait till we see the results of this initiative. Having a source (website, tool, whatever) that tells me how many people are in line ahead of me, and is refreshed on a periodic (monthly as new bulletins come out) basis will take a lot of the guesswork and day dreaming out of this.
A lot of us are in this mess for the long haul. A clear picture, even if it doesn't make the dates move any faster will ease a lot of anxiety and frustration. Atleast for me, it will.
If you're sitting on your ass thinking that there are other people contributing and their contributions alone will help meet the goal, you are wrong, most people are thinking the same way.
The way I see it, if you don't contribute/act to solve problems that you face in life, you have no right to whine about them.
Be like me, contribute, and then whine all you want.

so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?

Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

In this situation what does the person (with h4 dependent in the same situation) do ?
Is this a solution:
Make h1 premium now and get the 797 approval, wait for 485 receipt and then go to Canada for getting h1 visa stamping and new I94 card ?
Please advise. Appreciate any suggestions you can give with your limited time :)
