    applied June 27th( NSC ), still no FP..
    Called them yesterday..the lady said that we need to wait for a 102 more days before they can consider this an issue :eek:

    basically, there is no time period for FP , if we dont get EAD in the time frame then we call and ask. That's what the lady suggested.

    we need to track if it happening to a lot of people.

    I applied in Dec 2009 and got approved in May 2010.

    I am working for a different IT company and the LLC what I am going to register is exclusive for handling the franchise business.

    Since you have Valid H1b, using H1b is better option. EAD � you need to renew it every year. If you are in EAD, then you have to have AP (if you want to travel abroad) which also you need to renew every year.

    If anything goes wrong in your I485 (just in case) you will be in trouble, but that is not the case if you are in H1B. I am not saying EAD is bad, but comparatively Valid H1b is a better option.

    If your previous employer won't revoke I140, then no issues, even revoking of approved I140 by your previous employer will not have any effect as you have completed 180 days after filing your I485.

    i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
    i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

    In order to be able to finally adjust status when your priority date become current you must either maintain a continuously valid advance parole or H-1 visa. Alternatively, you could file an I-824 requesting that your approved I-140 be transferred to the National Visa Center so that when your priority date becomes current you can apply at the US Consul in Canada for your immigrant visa.

    Hello,

    Yesterday i recived a hard LUD on my I-485. Below is the new status from the USCIS website.. Does anyone know what this means ?

    I applied for I-485 in July 2007.
    My PD is March 2005
    I-140 Approved.

    Nikon Coolpix 5700 lens question-
    Retired guy needs advice. I bought Raynox Digital DCR-5000 0.5x Super Wide Angle lens from Abe's of Maine for $99.- but with NO threaded front element for a UV filter.
    And I bought a Vision Optics Titanium 0.48 Wide Angle with Macro from www.mydigitalgear.com (http://www.mydigitalgear.com) also for $99. and it has a threaded front element for a UV filter.
    Has anyone had experience with these? Or am I better with the Nikon Lens for $150.? I appreciate advice. Thanks. ed61115@gmail.com

    It is common. Your 485 is based on the denied I140. If the I140 is appealed then the 485 will also be tranferred to the Appeals Office. That does not mean you I485 is denied. It is
    still under process and you can apply EAD and AP as well.

    I am saying this with my own experience. Hope this helps

    Hi,

    Thanks FactoryMan. I had a similar question. My thought is that if the spouse is a dependent, then it shouldn't matter what status s/he is, as long is it is legal.

    The next question is, suppose we apply for EAD, but the spouse's current student status expires before receiving the EAD, do they fall out of status?

    I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(

    Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

    You can file uptill Sep30 2010, or when the quoto gets over, whatever happens first.
    And as far as your start date is concerned, if your H1B is from the 2009-2010 quota and you've applied for it after oct 2009, it can start anytime after Oct2009 till Sep2010 ( the date your H1B gets approved), please get this confirmed though.

    What is the reason behind you saying 'case may be audited' for the OP. Just curious to check your side of thoughts.

    Per lawyer, almost all EB2 cases are being audited (due to the harsh economic climate). DOL believes that if a job falls under Job Zone 5, then it requires enough preparation to justify a EB2 filing. If it falls under Job Zone 4, it's not "normal" and DOL would usually require a Business necessity letter.

    Last year I sent both the ITIN form and 1040 to the ITIN address. Once the ITIN is processed, they will update your 1040 with the ITIN number and forward it to the respective department for processing. I got my refund back after 8 weeks. Since I am in Texas I didnt have to file for state taxes..So not sure about the state tax filing part....
