Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.
I have been contacting to get my priority date corrected on I-140 approval. Please respond if anyone has information
You cannot fix a priority date error through a phone! This is a serious thing and would need to be corrected through a letter from an attorney or something like that.

Hello motivated,
you can search some good online universities to join her and change her status to F1.She can do MBA or Masters through some accredited online university,so that she can attend classes online no need to go anywhere.
If you try in this route she can get her CPT/OPT so that she can work,
and will achieve masters degree finally,which will help to find a sponsor easily.
If u want to persue that job which is offering you bright future,may be this is the option u can use to maintain the status of your wife.

Six years of my H1B expires on Oct 2010. Company A had filed my PERM in April 2009. I was laid off by Company A in Jan 2010. I found another employment and joined Company B in Feb 2010. Company B has filed for H1B transfer with 2 months recapturing while I was outside US thus possibly a visa date of Dec 2010. I've read in this forum that Company B can ask for 7th year extension based on pending LC for more than 365 days with Company A. But my LC from Company A was approved in Feb 2010. Company A will not file I-140 for me. Can someone please tell me if it is still possible for 7th year extension with approved PERM but no pending I-140?

I ran into similar circumstances in 2008 and i accepted some amount on 1099. So far nothing has happened. At that time money was more important for me than anything else. It was just one instance in my 5 years on H1. Right now i applied for I-140 and waiting for approval. I maintained my H1 status pretty good all the time. If there is ever an enquiry i'm thinking of explaining the proper reason why i accepted the payment on 1099. Hopefully there shouldn't be any problem.
To sum it up, It is illegal to accept payments on 1099 when you are on H1. And i would advice everyone to stay away from 1099. Every case is different and you never know what is going to happen

I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

Folks,
The "Time as Resident in a USCIS District" clause in the naturalization process says that "Most people must live in the USCIS District or State in which they are applying for at least 3 months before applying".
If you have gone thru this process could you please tell if this means that
a. the person must have stayed for at least 3 months during any time during of the residency period to be eligible to apply in that district
OR,
b. the person must live in the district for at least 3 months immediately preceding the naturalization application (for example, if applying in July 2010 then must be present in that state/district at least since Apr 2010)
The reason I'm asking is that I know people who live in India after GC and then come return to get citizenship...so wondering how it worked...

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

8/27 should be your Notice Date... per online status it will say received on 8/27.. but its ND... Once you get physical receipts... the RD has to be 7/24 in all normal scenarios... But for July fiasco filers.. I think it could be just 7/17... Update once you get the physical receipts.. I may be wrong... just noticed this in one case only yet...

I have read on this forum and an immigration lawyer also confirmed to me that knowing the I40 receipt number itself is enough. She said that I can print out the case status of I140 approval from USCIS website and use it. Though I did not take the job offer for which I needed this information so I have not used it.
FOIA should not take 8 months.. I applied for it at end of Jun and my number was around 3900 and it is now around 800 so I expect to get it in next 1 month so FOIA should give you copy of I140 in approximately 3-4 months.

Hi All,
I have efiled for my AP and EAD. I have received the RN for the same. I am planning to travel out of country by end of November. I am pretty sure AP will not be approved by that time. I am planning to travel on H1B visa. My attorney tells me that AP will not be approved if I travel before it is approved. I have to be in the country in order to get the AP approval. Is that true?

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

You are not subject to the cap. As you spent more than a year outside the US , you have the option of resetting your H1B clock (in other words ,apply for a H1 which would be valid for 6 years ,but would also be subject o the cap) or reviving your old H1B which would not be subject to the cap.
If you need a reference ,PLease refer to the AC21 provisions.
I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

Should be out by at latest the 15th... the bulletins in the past have been released in a range between 5th to 15th of the month.
I think with the Columbus Day holiday recently, they might take an additional day to release.
