I went for stamping in Canadan and before they even interviewed me they invalidated my visas by stamping them.
So the old visas don't remain valid so you won't be able to get in if your visa is rejected.

New Jersey Sen. Robert Menendez plans to reach out to a South Carolina Republican to craft a bipartisan immigration reform bill in the next Congress.
But it's not clear that Sen. Lindsey Graham will want to work with the top-ranking Hispanic Democrat on Capitol Hill.
Graham spokesman Kevin Bishop said last week his boss wants Congress to pass a 10-point plan to boost border security before attempting to overhaul the immigration system.
Menendez introduced an immigration reform bill just before the Nov. 2 elections that he said takes a middle-of-the-road approach, incorporating ideas that Republicans such as Graham, Sen. Jon Kyl of Arizona and Sen. Orrin Hatch of Utah have presented in the past.
Menendez said in December that Graham has expressed interest in writing a bipartisan bill.
"If he is, then what I hope to do is to draft something together that will have some level of bipartisan support," Menendez said. "If that doesn't happen in a reasonable time period, then I'd like to introduce the bill again (in the next Congress) as a foundation to get something moving. If there's nothing to have hearings about, nothing to debate over, you will never move forward."
But Bishop said Menendez and Graham haven't discussed working on an immigration bill.
The Menendez proposal, co-sponsored by Sen. Patrick Leahy, D-Vt., would eventually legalize illegal immigrants, improve border security, crack down on employers who hire illegal immigrants and make it easier for legal residents to bring family members to the U.S.
Graham has a history of working across party lines and often has been the only Republican willing to buck his party to strike political compromises. But that approach may be politically risky now that the GOP has turned more conservative under the influence of the Tea Party movement.
In 2007, Graham joined Republican Sen. John McCain of Arizona in pushing hard for an immigration reform bill that Menendez helped write. But the measure died in the Senate, with Menendez ultimately voting against it because some of his proposals had been stripped out. The measure never reached the House.
In 2010, Graham collaborated with another liberal Democratic senator, Chuck Schumer of New York, on an immigration reform plan that called for legalizing about 11 million illegal immigrants and improving border security. The two discussed the proposal with President Barack Obama at the White House.
But Graham quickly ended that partnership, accusing Democrats of politicizing the issue and citing his opposition to the Democratic health care reform bill.
Aggressive GOP opposition to Democratic immigration plans was evident during the lame-duck session when Republican senators -- along with some Democrats -- teamed up to kill the DREAM Act, which offered the children of illegal immigrants a path to citizenship if they completed two years of university or military service.
"Illegal immigration is a nightmare for America," Graham said in a December statement after the DREAM Act died. "Giving a pathway to citizenship without first securing the border is an inducement to encourage more illegal immigration. This is nothing more than a political game by the Democrats to try and drive a wedge between the Hispanic community and Republicans."
The DREAM Act's failure lessens chances that a broader immigration bill will pass a deeply partisan Congress, Menendez acknowledged.
"These are . . . children who came to this country through no decision of their own," he said. "They were brought here by their parents. Overwhelmingly, they only know America as their country. . . . In April, Arizona enacted the nation's toughest immigration enforcement law, which allows police to detain and question people about their immigration status. The administration is challenging the law in court. Several other states are likely to pass similar legislation.

EAD Efiling was done on Monday 06/23, but haven't used AC21 till now.
But there is a soft LUD on 485s (both mine and my wife's ) on 06/25.
I don't know exactly what is, but i think it's related to EAD renewal. Because my PD is Nov/2003 EB3 india and there is no way i'm near the end of road for GC

I-140 onwards in good 'ol days when there was no PERM because your LC would not reach USCIS untill you applied...now i believe you file PERM with USCIS so it would be LC. ....someone correct me if I am wrong.

Who are the guys making more than 250K? Why are they stuck in retrogression?
I am assuming that if you are salaried employee and making more than 250K, you should be at executive level qualified for EB1 visa - which is current for all countries.
These folks are most likely doctors...doctors salaries are in that range.

I did send the $15 for overnight return. The consulate is saying they are taking 20 business days now to issue new passports. Even i had good experiences in the past where they send the stuff back within a week. But just my luck , that this time it is taking forever!!!!

I looked at your signature timeline and it says "LC denied due to date missing on ad portion." Could you please clarify what happened? My job ads are running right now for PERM LC and not sure what I need to keep from the newspaper ad.
I have taken screenshots of Job Order, Yahoo HotJobs, Professional Organization, University Placement etc. I hope the screenshots showing the ad and all the dates would be good enough.

Man you are in such a good position . I think with an approved I-140 in EB3 for Sep 2001 PD your GC should not be far away .. Don't mess around with it by changing it to EB2 or things like that. It might get complicated . I would say have patience for a few months . Once you get your GC you are free.
Using AC21 is not a bad idea for those whose GC is a distant dream but for you I think the goal is within sight.

The future appears bleak and depressing considering the recent FOIA numbers which put EB3 GC wait times at approximately 8-10 years. Is there no hope at all? :(
There is no hope at all especially when our priorities are so misplaced. Just see how many members even post to any meaningful thread and whenever there is any meanigful thread people are out there to make every effort to derail it using cheap tactics.

But for 140, ability to pay type of RFE can and will be answered by company financials etc. It's just that if you are already employed and are getting more than LC proffered wage and can prove that via W2+paystubs.. it makes it simpler even when company doesn't have enough assets or profits.
But it's not completely a must have,

You can count on getting some type of RFE somewhere in the process that will ask you to prove the status.
Normally W2 and Paystubs are basic stuff that maybe asked even at the time of 485 decision.

Forgive my ignorance, but would you be able to use the extension tubes mentioned above with a third party lens like the Sigma Gary mentioned? Obviously the Sigma lens would have to be a Nikon mount since the tubes mentioned above are Nikon, but assuming the mounts were the same would that work?

Just sharing my experience that I just got my H1-B 3 yr extension about a month and a half ago. I applied for I-485 in July and have since gotten my EAD etc. I applied for the H1-B in October and got an approval very quickly, without any issues. I think the rule is if you have an approved I-140, you can get a 3 year extension on your H1-B (as opposed to the 1 year extensions you normally get after the 6th year of H1-B), the I-485 application has nothing to do with it.
The H1 was set to expire in March next year and this would be my 2nd H1-B extension (so similar H1-B time to yours).

As per my lawyer, if for some reason, my EAD renewal next year is delayed or the new card not delivered on time, I will not be allowed to work though I will not be illegal. Keeping this in mind, and also after reading numerous posts online, I got my HR to give the nod for the H1 renewal. My lawyer replied today saying that we cannot get an H1 extension as my 485 is filed and 140 cleared.
I was under the impression that I would be allowed to get the H1B renewed for another year. What are the rules / regulations on this. If someone can pls update me.

Thanks jsb....I didn't know this....But I think its still better if I wait for 140 approval...Then atleast one other uncertainty will be removed from my GC journey...Hopefully it would only take a month or two more than normal processing time for my 140...If it gets delayed further, then I might use it anyways..It's nice to know though that I have an option..Thanks again

My lawyer sent me the fedex tracking sheet for the I-485 package sent to:

I did not see any PO Box on the Fedex tracking sheet. I am not sure if she put the PO Box on the shipping label or not??
Is it a big deal?? Will my application be accepted.
