When you give your FP had nothing to do with the date your NC is initiated (done a couple of weeks after ND)
I am not sure what is the process after fingerprinting. Can someone please clarify?
I believe NameCheck must have been initiated. As far as processing 485 is concerned, does the PD have to be current?
I am trying to figure out what is the tentative schedule for the "magical" GC to appear in my mailbox :) ?

dude.. that attitude might not help you on a public forum where people offer help/suggestions for free... and c'mon, this isn't your english class.. so I guess if you can understand 'ur' is 'your'.. you can get over it.
coming to your point, I see no reason why you can't... only catch is, if you have already used up your 6 years of h1, then the new h1 time is in excess of 6 years, which will be approved for 3 years only if your AOS is pending and your 140 is approved.

Foreign physicians who received medical training in J-1 program must either return to their country or obtain a waiver before they can apply for an immigration visa, or change to almost any other nonimmigrant status. A J-1 waiver can be granted when the physician commits to practice medicine in an underserved area of the United States for at least three years. An area that is designated as Health Professional Shortage Area, Medically Underserved Area/Population or a VA facility normally qualify such requirement.
J-1 waiver applicants first submit their application (DS-3035) to DOS (Department of State) processing center. Subsequently, the applicants and the sponsoring employer must submit all information to IGA (Interested Government Agency) which will review the application and then forward the recommendation to DOS Waiver Review Division (WRD). After WRD issued its own recommendation, the case will be forwarded to USCIS for final decision.
J-1 waiver once granted, the physician will work in H-1b status. Therefore, J-1 waiver applicants must also qualify for H-1b requirements. As soon as WRD issued its recommendation, H-1b application can be submitted so that it can be adjudicated with the J-1 waiver application.
IGA can be a state department of health or any other federal agency, including Department of Veterans Affairs, the Appalachian Regional Commission, Delta Regional Authority and US Department of Health and Human Services.

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....

Hi,
I am trying to fill the G325 Application. I have one field left to fill Alien Registration Number. Is this the I-94 number or any other number on the Visa or any other document?

Alien registration number is found either on I-140 receipt/approval on top of beneficiary's name. If you're not sure, just leave it blank or put N/A. This is different from I-94 number.

I had applied for my I-140 to seek an extension from Oct-09 to OCT-10..Instead I recieved an I-140 with expiry date of Oct-09 itself..what to do now..I know its a genuine mistake..but not sure how to get that addressed..:confused:

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.

I lost my job in January and since I was not able to get a new project. So, returned back to India in May'09. My AP was valid till 21-July-2009. I did not file for extension while in US.
Now, I am getting a job in US and the employer is asking if I could join immdiately. Please let me know:
1. If there is any option for me to renew my AP from India?
2. Any other options, since my H1B got expired (6 years) in May'09.
Note: My EAD is valid till June 2010.

1. When is the LATEST you should start working for sponsoring employer ?
(e.g. If card received on 3rd of the month, do you HAVE TO start same month or can wait for a month or so ?)
2. If salary, after GC, is lesser than mentioned during Labor stage, what problems will it cause for:
- GC renewal ?
- US citizenship ?
- OTHER problems (GC Cancelation, Deportation...)
3. What if, after GC, sponsoring employer gives termination letter with:
- NO reason ?
- reason stating bad economy ?
Please tell, for each case, what problems will it cause for:
- GC renewal

I am in a strange situation. I was on H1 and applied for H1 extension, I also applied for F1 and got approved for that. Once I received my F1 approval I told my employer to cancel the processing of H1.
Now my employer says that the H1 was approved. Now which status I am in is the main problem. Can I find out which status I am in by any means? what happens if my employer cancels the H1 will i be on F1 or is my F1 no more valid? please can someone help me as I need to take a decision immediately.

You can fillup forms online before wedding date but appointment date should fall after your wedding date.
