Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.
I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???
How to check the stability of a company before you start filing anything ???

I got my EB3 I-140 approval after I applied my I-485 with later PD EB2. Our lawyer sent a letter to USCIS, but there is no confirmation from USCIS. Please let me know, if there is any way to check the PD.

This is some really interesting data. After looking at this, I'm not sure what recapturing visas means. Be cause it looks like both the FB and EB quptas have consistenly been filled. if you look at table 6.

Please forgive me if these kind of posts are not allowed (Admins, feel free to remove this post if this is not the correct forum).
I am getting ready to apply for PIO for our new born (born in US) but one of my friend mentioned about applying for OCI instead.
The information on eligiblity for OCI in the NewYork consulate website is little confusing. My question is since me and my wife hold Indian passports, would my new born be eligible for OCI?
Also is there something called CIO (Not Chief Information Officer)?

I think that it is very common to get the EAD card with Finger Prints not available printed. I do not think that you should be worried too much about this.

Can anybody provide some information on how long the wait would be.

On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

Here is a clear example of business leaders moving ahead of the politics of this issue. It will have an impact on any sensible person.
It should get onto as many news wires as possible. Which sensible person can say that those 1000 high paying jobs going to Vancouver/Canada is in the interest of Seattle/USA. Imagine to spin off losses of this, to housing, to retail, to all sorts of areas of the economy where many Americans make their livelihoods.
This is what people don't understand, push them too far and capitalists will weaken the US economy.

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
Yes it is true that the K3 visa may take a year and the spouse must remain in the home country during that time.
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
She can try for K1 visa but it must be filed now and she must come to the US before marriage. The K1 visa processing can take a few months so your cousin may be running out of time.

The question is : If my h1 is with company A and my GC is applied for future employment by company B, can I use EAD to take up full time employment with company C (or Self) ?
The full story is : The client company, I am working with is processing my GC for future employment. 485 was applied and I received EAD. It has come up that the current employer has an agreement with the client that , the client should not employ any of their employees for 1 yr after the termination. So, I need to quit the current employment, work else where for a year and then join the GC sponsering company.The I140 will not be revoked.
Since I am not currently working for GC sponsring company, does any of the AC21 issues matter ?

Do they receive a new 90-day period upon re-entering the United States? What if they go to Mexico or Canada or another adjacent country?
According to the CBP, An alien admitted into the United States under the Visa Waiver Program (VWP) who departs to visit a third country other than contiguous territory or an adjacent island and then returns to the United States to apply for admission as a temporary visitor for business or pleasure under the VWP, would receive a new 90-period of admission if he is found to be admissible.
If the same alien traveled only to foreign contiguous territory or an adjacent island, he would generally be readmitted for the balance of his original period of admission if found to be admissible. An alien is this situation may request to be admitted for a new 90-day period and be admitted for that new period if slbe is found to be admissible.
Please note that any VWP applicant for admission must establish his admissibility to the satisfaction of the inspecting CBP officers.
