Hi All,
You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!

All that was asked - was to write to the Radio station using their website. Who asked anyone to picket?!!! Re-read my post. I asked members to call up and ask hard questions challenging his credibility. We have nothing to lose by doing so. If we make him fumble, he stands to lose a good following.
I'm part of that 10% that you're speaking about. Are you? Have you joined your state chapter? Did you march in DC? Are you a regular contributor?
What's wrong in using Gandhi's name? Are you allergic to the great man?
Any day a Gandhi quote is better than the - 'This can't be done. That can't be done. It's all in vain' statements, which are highly negative, demoralising and triter than the usage of Gandhi. At least Gandhi quotations are positive and uplifting. And we need that here to balance the pile of the negative statements that get posted.
It's a promise. Until you guys don't get tired of posting your negative and demoralizing posts, we won't be tired of invoking the Great man's name. We know it's vain to invoke Gandhi to you guys. But still hoping against odds that it may affect you in a positive way. :)
Well then why dont you picket against NumbersUSA, programmers guild et al too, i can name 20 conservative radio shows try emailing/talking them to change their opinion. I say this because i have emailed to a few and even tho they understand my point of view they will not change something that gets them ratings and propagates their cause.
IV has 25k members, i guess 10% out of those are really motivated to participate and ready do something, if you start diverting your resources towards such issues your team will not have much motivation or people remaining when you really need them to do something. IMO

I see that Dream Act folks are trying to get > 60000 points, to showcase their support. We need to match for the posts like Legal Immigration in there. Currently the top posts for "legal immigration" are around 2000 points. Not many ppl are not taking interest.

He spent his money and got his H1(he belongs to a particular Indian state)...came to US with his family...ofcourse he did not have any IT skills... so after coming here he was working as a Grocery shop manager owned by a Desi guy... still on H1B.

If we do not get this problem resovled who will ? All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok .. my I-485 was pending from 2001 and then my case was transfered to NBC I had an interview and then I got the I-797 Welcome Notice welcoming me as a permanent resident of the United States and it said on the notice you will get your green card in the mail in about 3 weeks and then checked my online status it said we ordered the card for production
ok at this point everything is looking good
and then after 5 days check my status online
found the following :

Ok, with the latest developements, I have applied for my 485, EAD and AP this week. My current H1 expires in June 2008.
If I get married before June 2008, I can still bring my wife to US on dependent (H4) visa. My question is, for my wife
to be able to file for 485 then, do the visa numbers have to be current at that time? And if they do, and say the numbers are not current at that time, and then my H1 expires come June 08, will she be out of status and can she remain in US? What are our options then? How does this work??
Can anyone explain PLEASE? :confused:

As your lawyer used the words "change of employer petition", it seems that one can use AP to travel and still after coming back he/she can file for either extension, amendment or transfer. This answers the main concern that I started this thread for.
Also, on other threads I read that its possible to file H1 amendement even if your H1 is still valid. This is one way to come back to H1 status and get a New I-94 card.
Some one also mentioned that if you have a valid I-797 extenstion approval notice and if you show that at POE to IO, he/she may issue an I-94 till expiry of I-797 (3 years) instead of AP (1 year).
I would appreciate input from others who have some knowledge or experience of above situations.
Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. I know Aman has made a no. of trips to DC & these are not cheap.
Let us all contribute to pay back all his trips .
I am serious about it as people have no idea what people like Aman & others have done / sacrificed. If fact, we should authorize the Money Manager of IV to immediately release the entire amount Aman & others have spent since 19th December 2005.
I am sure IV must have funds to handle this... if not, atleast start a part payment each month immediately

Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?
First of all, I am not threatening to quit IV.
Secondly, even if I quit, its not going to matter to IV.
IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.

From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
As for you, it appears that as long as your substitution is approved before the law comes in to effect, there won't be any problem. If not approved by that date then it's kind of fuzzy as to what will happen. If you haven't filed already, just file premium and I am sure you'll have your 140 approved before the law takes effect.

The whole premise is influence. Meaning even though the lawmaker (representative) knows that the callers cannot vote or donate to his/her campaign yet, this "yet" is a powerful incentive. They know that sooner or later you will become a permanent resident and eventually a citizen and are already contributing towards the constituency by paying taxes, there will be an incentive to work for the agenda of tomorrow's influential populous. Therefore I believe that it will not hurt to call lawmakers and will make a strong show of support from his/her constituents. Of course, this is just one avenue and other avenues are also being pursued like petitions, lobbying, flyers, campaigns etc.

@Mayday i may not be able to file a police complaint as i do not know the proceedings and also do not have the time with all the movement thingy happening right now,but i am making my documents solid for DOL, so that he cannot escape, atleast his name gets blacklisted while applying for H1B for the next 5-10 years or best he gets dumped or shut
